50 bucks huh?

I understand that it is the principal of the situation that has caused you to want to get him back.  I also know that fifty bucks is a lot of money to lose.  I believe your time and fifty dollars would be better spent as a lesson learned, move on.  Unless of course there is some legal recourse.

Easy.  contact e-bay.  explain you are considering a lawsuit as they are allowing a known thief to sell on their website.  have all the other people scammed by this guy sign it also, or at least list their names and account names.

first off find a friend to e-mail the seller.  once you get his e-mail track him that way.

well I tried all that and so did some of the others. The problem is that what I purchased was a pre-order item, meaning it was something that he would have to order and then ship to me when it was released. By the time I figured out that I was not getting anything, both flea-bay and paypal, (ONe in the same I know) said it was too late to use their resolution center for help.

They are still at fault for letting him post again.  the fact still remains he did not honor the deal, and has no intention of doing so in the future..therefore they are knowing helping him commit fraud.

and if the auction was for an item not yet possessed by the seller, then the contract with e-bay isnt over till that time....the 60-90 day rule doesnt apply...unless you waved that right by bidding.
