A state appeals court got it right on Thursday when it prohibited East Brunswick from denying a gun-purchase permit to a handicapped township resident. As a result of its decision, the appellate court delivered a victory for disabled outdoorsmen in particular and handicapped citizens in general.

The East Brunswick Police Department denied the permit on the false and prejudiced notion that Charles Breitweiser, partially blind and partially paralyzed, was automatically a danger with a gun. Not so.

In Breitweiser's case, he wanted the permit to buy a rifle for hunting. By doing so, he would join the thousands of other physically disabled citizens across the United States — many with disabilities more serious than Breitweiser's — who participate without mishap in the sport of hunting every year, so long as certain precautions are followed.

Breitweiser was willing from the beginning to submit to certain restrictions, among them the use of special equipment, never hunting alone and passing the state's hunting license requirements. Such safeguards already are in widespread use by disabled hunters across the nation.

In fact, disabled hunters are nothing new. Numerous groups all over the country exist for the sole purpose of helping handicapped Americans enroll and participate in the sport. Safety is a prerequisite, and outfitters sell special equipment toward that important end. Knowing all of this, the decision-makers in East Brunswick — and in the Middlesex County Prosecutor's Office, which backed the township — insisted on promoting their particular form of discrimination anyway. Shame on them.

Breitweiser, also a motivational speaker for people with disabilities, is thoroughly capable of managing life's many tasks, the sorts of things that fully healthy people do. Yes, there are times he may need some help. But the whole point of laws to aid the disabled is that physical limitations should never become an excuse for imposing arbitrary limits on personal freedoms, so long as reasonable and safe accommodations can be made. In this instance, it is clear they can. Case closed — hopefully, for good.

As long as he can hunt safely OR handle a weapon safely there is no reason to deny him the right to purchase said weapon just because he's handicapped.

Exactly!!  I agree!!!!  If somebody judged my abilities based on the first inpression/visual effect I have on people, I'd never leave the house!!!!

Some states require you to get a permit for each handgun your buy.  I know North Carolina has that law, because I used to live there.  I think it cost $5, and there may have been a waiting period.  You go back to the Police and get your permit.  You take your permit to the gun store, and you are allowed to buy one handgun.  You have to surrender your permit to the gun store.

It's a stupid law.  And a damn good reason not to move back to NC.

Agreed here, but what if he wanted a firearm for its collector value or to pass to his grandkids?  How should he be denied the right to purchase the firearm even if he couldn't use it at all?  A permit to purchase AND denied due to disability.

I guess if I get hurt in the sandbox at some point I have to give my guns away?

OMG!!!  Thats a VERY good point!!!!  I want a hand gun, but until I find a way to adapt it to me, it would just be eye candy. It would not be right in any sense of the word to deny a purchase PERIOD!!!!

When I was there, you could get up to 5 permits at a time for that $5.  That is what I always did.  Not problem....

IL has the FOID (Fire arms Owners IDentification Card)  Same principle, but different method.  The only problem with that is that FOID card holders are in a big old data base so .gov can pay you a visit.

I know a gun smith that made a helmet mounted handgun for a hunter that could only move his head.   He can fire it by blowing in a tube.   As long as someone can control their weapon and use it safely, they should be able to do anything they want witha gun.

I have invisioned a sling type devise to put one arm in and trigger with the other. Now all I need are a few creative minds to put it together.
