Court Clarifies What Constitutes A Police Chase
(AP) SAN FRANCISCO The California Supreme Court says police cars chasing a suspect need to have more than flashing lights and a
siren if a driver is charged with evading police.

Monday's ruling clarifies a key element necessary to convict a motorist of evading police.

Ruling 5-to-2, the justices said a vehicle must look like an official police car -- that is, it must be equipped with a siren,
police lights, plus some other feature marking it as an official vehicle.

The court did not say exactly what those features have to be, but the opinion mentions police logos, various lighting styles and paint jobs.

The decision reverses several appeals court decisions that said juries do not have to find that the vehicle had more than police lights and a siren.

good i almost broadsided a police suv running code through a stopsign.... only had flashers IN the windshield and back so from the side you couldnt tell it was running code....

So if it's not really a 'chase', then do the cops still get sued when the bad guy wipes out running from them?  

"You see yer honor, we weren't really 'pursuing' him so to speak, as the State Supreme Court ruled that it's not really a pursuit if one of the cars is an unmarked unit".

I thought that CVC already spelled out what was required for a stop. Unless it has has been changed, 4 elements are required:

Marked car

Lights

Uniform

Siren as necessary.

I don't see anything different here. Whats new?
