Soldier pleads guilty in porn site case

FORT BRAGG, N.C. (AP) -- A soldier pleaded guilty Tuesday to having sex on a military-themed Web site for money and was sentenced to three months in prison.

Pfc. Wesley K. Mitten, 21, pleaded guilty to sodomy, conduct detrimental to the Army and cocaine use. He will be discharged from the service.

"I am sorry for disgracing my family name and my unit," he said, according to The Fayetteville Observer.

Mitten is one of seven soldiers from the 82nd Airborne Division accused of appearing on the Web site. Two others, Pvt. Kagen B. Mullen and Pfc. Richard Ashley, have also pleaded guilty and were sentenced to prison.

In court, Mitten said the Web site's producer contacted him through the Internet in 2005 and offered him $2,000 to perform in a gay pornography video.

Mitten also made another film, posed for pictures and appeared before a camera for Internet broadcasts, he said. He earned $6,000 in three months.

Army prosecutors said Mitten helped recruit other men in his division.

Four other soldiers were punished outside of the military court system. All four were reduced in rank to private, forfeited half a month's pay for two months, performed extra work and were restricted to Fort Bragg for 45 days. The Army has discharged one paratrooper and has recommended discharges for the other three, division officials said.

The guy wasn't court-martialed for porn, he was court-martialed for COCAINE, and the rest of the charges went along for the ride...

Notice, everybody else 'involved' got a field grade Article 15, for 134 violations (somewhere between a misdemeanor and a civil citation in civillian terms - 1 month's pay, loss of rank (that's the worst part -> perminant pay cut), and 45 days of no off-post & crappy detail (extra duty))...

Unless things have changed, the military doesn't court martial for drug use on a first offense. I think it was the combination of charges that led to a court marshall, not just drug use. You will get Article 15 under the UCMJ for drug use, get busted, restriction to barracks, no pay due for (X)-months and have to attend  rehab classes. We had a guy from NJ in our unit that was using drugs, I believe it was cocaine too. He got nailed on a piss test -basically everyone from NY/NJ got the 'random urinalysis' when I was in. That wasn't enough for discharge by itself. It took a second failed test to actually get him the boot.

I've known folks get a summary CM for cocaine... I've seen a kid get by with no UCMJ for pissing hot in basic (pot, after Christmas) ...

It's commander's discretion of course... And yes, the totality of the charges probably contributed to it  (BCD Special or General -> he's out on his ass), but the 'porn' part seems to have only been 'bad' enough for a FG '15 for the rest - they totally gloss over the coke use when reporting the incedent....

I guess the policy is the same now for the Corps, they used to have one chance. I also remember some of the Staff NCO's saying that they didn't have drug screening when they were drafted. Is there any thruth to this?

Here's something we all got a kick out of.. The Sgt. in our unit that handled the drug screening was actually named Stoner. Yep, Sgt. Stoner was administering drug tests.

The AF has a zero tolerance policy, but it's also on a case-by-case basis. If his supervisors and co-workers want him to stay, and submit character statements in his defense, that goes a long way to keeping him in.

My drill sergeant in Basic told me that he had a soldier from several cycles before mine that was a porn magazine model.  Everyone thought he was bullshitting until he had a couple of magazines featuring him mailed to him.  Pics of him nailing two chicks at once, etc.  His family knew all about it, and were proud of him, according to the DS.
