I haven't sold at a gun show in many years. I'm thinking about trying to move some (12 or so) handguns which have been in my personal collection for years. I have an FFL. I know I can sell personal guns without 4473's etc., but I'm wondering if ATF would come down on me for it. Any thoughts from fellow FFL's here? Same issue if I put them on the EE or GB, except I'd have to ship to FFL for out of state sales, which would negate the 4473 question. Might be better than FTF. I have put personal and privately acquired stuff "on the books" in the past just to avoid any possibility of problems from .gov. In answer to the inevitable questions, they are S+W 38's and .357's. Some with department markings. I'll keep at least one to go with my 10/22. |

ATF says you "have to be engaged in the business" before you need a FFL. Showing up once at a gunshow to sell off extras won't attract attention as long as you don't stand on a chair & yell out "no paperwork at this table!" If you have any qualms, call your local (closest) office & ask them. Why you would ever sell a S&W is beyond me, but that's another thread! |

I DO have an FFL. That complicates things. A non-licensee selling a table full of personal guns is not a problem. An FFL selling the same stuff could be in a gray area, even though the regs state that it's OK. These guns were bought over the past 20 years with my license and I filled out the 4473's for them. So they are legit "personal" guns, not stuff being laundered to get it off the books. Just wondering if any other FFL's on the board have been in this situation and how they handled it. Don't need any hassles and would rather err on the side of caution to avoid undue attention. I may pull them out of the safe and decide they're too nice to sell anyways. |
Then I would sell them only as a regular FFL sale. The slight savings you could possibly find wouldn't off-set the potential tar baby it could become under Mr. Murphy & his many friends. Not too many times I have regretted playing CYA. ![]() My .o2 |
