I'll start at the beginning:  1 1/2 weeks ago i was sittin in my recliner @2 pm.  (on days off)  with a 1911 on the table beside me.   I hear the door knob starting to unlock on my front door.  WTF?!?!   I picked up my pistol slipped the safety off and held it on the door   (no one has keys but my wife and me and she was at work)  the door opens and someone takes 1 step in before i yelled STOP!  my lanlord throws his hands out and says, "hey hey hey, its me its me!"   I said (with the pistol still on him)  WTF are you doin?  He says " im just comin in to check your air filter on your AC"  I said its fine, and next time you need to call me before you just walk in my house, as per our rental agreement and also, knock or ring the bell before you just come waltzin' in....He says ok and leaves.

Fast forward to 2 days ago...i cleaned my kel tec p32, and left it by my chair when i went to work...notice later that night it aint there anymore...asked my wife, she hasn't seen it, so today i searched the entire house top to bottom, and my truck and cannot find it...my questions are these:

1.  Should i file a police report and say " duuuh, i lost a pistol in my own house" or what ?
2.  Can i legally change the locks on my apartment so this horses ass  cant come in anymore?

Really need advice...thanks guys.

As far as locks, if your renting they are supposed to have a key if I recall right.

Take the complaint to the property manager. If you go high enough up the food chain, you get to someone who doesn't want the hassle and it will get straightened out ASAFP.

If I got robbed, I'd file a report. I'd also mention the incident with the landlord. Stealing my stuff ain't nothing to play around with....

Per the laws in NY you can change the locks but the landlord has to be issued a set of keys.

Call and file a police report now!

I had a landlord that decided he would start showing the apt. I was renting 4 months before my lease was up. I was home sick one day and I heard the 1st floor front door open, no knock, no doorbell, no 24hr. notice that he was required to give, he made it to the top of the steps before I flung open the door and pointed a loaded, safety off Remington 870 at his chest and ordered him to freeze. He had 3 college girls with him and 2 of the 3 just screamed at the tops of their lungs, the 3rd ran down the stairs.

I told him the next time he did not call me and give me the 24hrs notice someone would be lying in a pool of blood and it wouldn't be me.

We never had a issue again.

File the police report.

That gets the gun on the stolen gun register or whatever the local gun shops and pawn shops sometimes have to call to verify if a gun is stolen or not.

The police also will know you are not the only one with a key to your door and there may be similar problems being reported.

I personally would install some sort of game camera that takes a picture of whatever opens your front door.  You will have a lot of pictures of you and your wife and you will know whenever the land lord decides to check an air filter or your wife's panty drawer.  Get one that does not make noise and take some test pictures so you know what lites to leave on and how best to position them.  They make digital versions now so you won't go through a lot of film but they are a few hundred bucks.  There are other options as well.

I doubt they will start a big investigation over just your gun.  But if someone else complains it helps to already have your report on file.  And depending on what else may be going on you might be able to show the police pictures of someone else with access to the land lord's keys who has been visiting a lot of pawn shops lately.

I despise apartments for this reason and consider them to be about like a dorm room when you have bad room mates who live somewhere else most of the time but drop by now and then just to annoy you.

Check down inside the chair VERY well first. Ours swallow things from time to time.
Then talk to the landlord
Then talk to po-po

Leaving a gun laying around like that is a big nono in my opinion.

You are renting the property. I doubt it is legal for him to just stroll in unannounced.

Call the cops. If he didn't do anything, he has nothing to worry about.

Texas doesn't have a state ordinance concerning notice prior to entry... check your lease.

+1 for the Police Report. You can always notify them if you "find" it again.

So you left your pistol out in the open while you went to work, knowing that the landlord has developed a habit of walking into your place without notice. Now you are surprised it's missing.

If you can't lock your guns up,at least fucking hide them when you leave the house.

People never cease to amaze me.

You should also think about reporting your gun as stolen, cover your ass in case the landlord decides to go on a spree.

he wasn't at home.

when you're not home, stash or lock up your guns ... especially if you live in an apartment where god knows who has keys to your place.

When your home, lock your door up with something they can't get past from the outside without forcing.

I use one of these whenever I'm in for the night in my place:

I also use it with a padlock to lock the closet door with my "shit" in it when I'm out of the apartment.

As for the Kel-tec, if you're sure you didn't misplace it, there's nothing you can do but file a police report, then tell your theif of a landlord that someone was in the unit, and many items are missing and were already reported stolen to the police. Grill him and confirm that he didn't allow someone else access to the unit without giving you notice.  Then tell him that the officer would be contacting him for a written statement under oath in the next few days.  That might just scare the retard into returning the item via spontaneous appearance.

Legally, No.

With that said, if he were an upright business man, he'd always follow the rules and give you notice.  You just make sure you are home to allow him entry when he properly rings the doorbell before trying the key.

If you consistenly open the door for him, he'll never know you changed the lock.

I did this for five years.  It's not ethical, and you are technically giving him grounds for charging you for locksmith labor if he discovers it.  You may also be on the hook for any damaged associated with him not being able to get in to curtail the spread of damage in the event of an emergency.

But really, with multiple gun$ stored within and the safety and peace of mind of your loved ones inside, do you give a flying F*ck about a few dollars in the off chance he figures out the locks were changed?

In this case, you need to move.  Change the locks NOW, start packing, figure out an exit strategy, then move.  By the time he is done verbally harassing you about not having given him a copy of the key and is ready to take action, (ie call a locksmith) you should be just about done moving out already.

Yep, check your lease and see how it is spelled out.  I know on the lease agreements we use as Texas Realtors it spells it out on page 6.  The landlord or his representative may without notice at reasonable times may enter the property and then it spells out for what reasons.  The one he gave you would fall within one of them.

I don't agree with it, but that is the way the lawyers wrote it.

1. Read this and check the laws in your state.

2. Search your house top to bottom

3. If you don't find the pistol call your landlord and let him know what happened and that he shouldn't be alarmed if he sees police arriving later as you will be filing a stolen weapon report.

4. Call the cops

5. Move asap.

I hate thieves. My uncle Al used to call 'em "cocksuckers", of course that what he called everybody. This sort of thing really pisses me off and is one of the few areas in my life where I tend to go to far. I would find a way to set 'em up and f**k 'em over good. If it works out right maybe you can kick his ass and get by with it too.

Where I used to work they had pinhole cameras that where used in "stings" when theft or blowjobs or just generally screwing around were suspected, very effective. You may be able to borrow some of that stuff if you know the right people , or just buy one as they have come down in price considerably. Some are wireless, but a little more expensive. They had an ultra slow vcr setup to run long periods of time but you could put one on a motion detector to conserve run time. You can get pretty creative about hiding them because they are so small.spank his ass.
