Alright, it's taken a week or two of talking to my best friend's dad into it, but he finally agreed to get an FFL. My buddy and I have talked him into it because since we are only 19, we can't get the license to conduct our own business, so we figure we can engage in business under his license and place of business, and we figure this is the only way (as of this point in our lives) to running a firearm "store" (we ultimately want to open shop when we can get a license for ourselves).

Primarily, we want to sell on the internet, and if people want to pay for transfers we will do that, since the place of business will be at his home.

My questions are:

1. Is it legal for this to do? IE for my friend and I to be conducting a transfer to someone and conducting the background check and following ATF procedures, or is the licensee the only one able to transfer a firearm to a non-licensee's possession?

2. Would we need to file taxes and register the company with the city or anything like that, since this will be run from home as a side thing?

We have been thinking about this for a long time, but we don't want to break any laws. Any help would be appreciated!

Since the FFL is in his fathers name he would be the owner of the business. You would have to be an employee of his business. All IRS matters would be his problem for the business.  Make sure that no city laws prohibit a gun store where the house is located. As far as transfer of a firearm I would think it would be legal since an employee of a FFL can run NIC's checks and sell weapons out of a gunstore.
