| Don't start a fight with an armed person and expect a fair fight. The deputy claimed he was trying to grab his gun and was unable to get control of the suspect and that's when he was stabbed. Sounds like suicide by cop, the suspect even said he was trying to get his gun because he wanted to be shot. Lawsuit should be tossed unless they can prove something not provided in the article. |

That’s how departments respond to lawsuits. It was a County Deputy, using a WA State Patrol intoxilizer at a weigh station used by the commercial vehicle enforcement troopers. And I believe there was nobody else in the whole place. But yeah, policies tend to follow knife incidents, we had some almost come down after several incidents locally of suspects grabbing LEO’s knives, leading to shootings or knock down fights. Not uncuffing someone during the intox is the safest play. I never took them off unless they were going into a holding cell for a while. Too big of a risk of a fight, relying on someone’s good will after you have arrested them is not smart. This kind of incident is exactly why they should stay on. Only policy that needed/needs changed was to not take the cuffs off. Problem (mostly) solved. Hope the family gets nothing. Tired of criminals families getting paid on good shootings. This is what happens when govts settle instead of fighting it in court. If the use of force is justified, the method used is if no concern. Use of Force 101…. |

Kind of half wonder why there wasn't a camera installed in breathalyzer test room or hallway. Knife in question looks to be a Benchmade SOCP style. They are marketed as LEO backup knifes. I don't see the butterfly. It could be a knockoff. I carried and trained with a SOCP Mini for a summer. It is intuitive as a last ditch weapon. It kind of sucks as a knife overall. *ETA Re other posts about the legality of knives. The reason I tried the SOCP it was actually legal in my AO for normal people to carry. |

Agencies pay a lot of money for data storage. Would be really expensive to pay for all the unnecessary data of a cop aimlessly driving around during his shift. Local agencies to me have to record every public interaction including phone calls. If officers don’t have it recording during an interaction they can face disciplinary action. |

Thanks to the elimination of black jacks, the cop's only other choice was hands on, while fighting for your gun. No such thing as a fair fight. When I was working, I carried an auto folder on my support side. If a perp grabbed my gun and had their hand on it, I would pull up on the bottom of my holster, trapping the gun against my side so that it couldn't be pulled out, along with your hand. I now own your hand and arm. If necessary, I would take my support hand, deploy knife and go for your neck/face and try to keep my mouth closed to avoid the arterial spurts. Felony disarming of a LEO = you made your choice and chose poorly. |

The bodycam was on up until they were actively fighting once the suspect was on top of the deputy. It seems like it got accidentally deactivated while fighting. Then he reactivated it after they had secured the guy and were giving medical aid. It being "muted" was during the pre-recording buffer, which is what it's designed to do. There's literally nothing the deputy could do to change the muted portion. Watching the bodycam, I'm inclined to say "good stab". I'd assume he should have secured his pistol before doing the breath test, but the deputy isn't the one who escalated anything. |

When Fogle asked Layton if he was sure and how many troopers were in the building, Layton turned and asked Fogle why he was saying that, according to the video. Layton told Fogle he was going to put him back in handcuffs and instructed Fogle to stand and turn around. Fogle stood and asked Layton if he was sure. As Layton pushed Fogle’s chest to turn him around, Fogle can be seen in the video reaching toward Layton’s waist. Layton can be heard shouting at Fogle to get away from him. Layton radioed that he was fighting with Fogle and that Fogle was reaching for his gun, according to the video. Layton shouted, “Marc, you’re going to get (expletive) shot,” and Fogle replied, “Yeah, that’s what I want.” Layton repeatedly shouted at Fogle to get away from him, the video shows. The pair can be seen falling to the ground, with Fogle on top of Layton. Fogle can be heard saying, “I’m not looking to shoot you,” moments before the video summary says Layton’s camera was deactivated during the struggle. The video resumes with Fogle lying face down on the floor, now in handcuffs, appearing to be nonresponsive. Layton can be seen cutting off Fogle’s shirt and sweatshirt, revealing more than a dozen stab wounds on Fogle’s upper back. Layton can be heard out of breath, asking a state patrol employee, now seen in the video, for medical supplies. Layton told Fogle, “I’m not going to let you die, Marc. You’re going to be OK, man.” Fogle can be heard in the video groaning and giving an unintelligible response. Medical personnel arrived and pronounced Fogle dead at 12:39 a.m. May 8, the video summary states. Layton remains on administrative leave, which is standard protocol. The Office of Independent Investigations is investigating the stabbing and will forward its report to the Clark County Prosecuting Attorney’s Office for review. Not guilty |

Yeah, it certainly looks to me like the BWC was accidentally shut off during the scuffle. Someone would have to be pretty…uhhh… biased(?), to think that the officer in the middle of a fight against a heavier dude on top of him and trying to gain control of his firearm, had the presence of mind to go, “Ya know what? He’s going for my gun. I’m just going to stab his fat ass. Lemme turn my camera off, first”. I think the issue others have mentioned, is the responding officers apparently all muted their cameras when they arrived. Apparently one officer was recorded saying, “Oh shit, he stabbed him” right before muting their camera. |

Sounds like it was inadvertently turned off during the scuffle. There's a big ass push button on the front that starts and stops the recording. It's easy to bump on and off, especially while fighting someone or carrying something. Edit: Beat. I love this gem from the one article: The sons also claim Layton’s holster brand is “specifically engineered to prevent a person other than the officer from drawing the firearm out.” There is no such thing. Yes, Safariland produces level 87 holsters that helps mitigate the ease of someone trying to disarm its user. However, in training scenarios, I have successfully disarmed guys using such holsters. From the front, side, and rear. Rear approach is the easiest for disarming. |

ALL electronic devices must be turned off around the breath test machine to prevent interference. That includes cell phones and body cameras since body cameras all have cell connectivity these days. There are plenty of times it's okay to turn your camera off. |

FIght starts about 8:30 in. The DWI suspect got the Deputy on the ground and had him in a mount (suspect on top). If you press the big button on the front of an Axon body camera for a couple seconds (depending on settings), it will stop recording. It is most likely that the suspect's own weight stopped the recording. In a fight for one's life, nobody is going to have an extra hand to stop recording so that they can do something nefarious. Inadvertently stopping the recordings because of things like that happens sometimes. The biggest culprit is often the stock of a long gun. You don't even realize it until you look down and see that the light that tells you you are recording has stopped. The suspect's wounds were consistent with the Deputy getting his non-dominant hand free to access his knife while he used his right hand to protect his holstered weapon, with a suspect in the mount position on top of the Deputy. The suspect appeared to have a bunch of stab wounds in the back. Deadly force is deadly force. If you have a legal path to using deadly force, it doesn't matter is you shoot them, run them over, hit them in the head with a brick or set them on fire. Or stab 'em. But the latter options will take more explaining. Cops used to get killed with their own weapons alot more frequently in the 1960-70s. Sometimes it was 20-30% of the total officers killed in a given year. Holsters got much, much better for retention, and training changed to include weapons retention and that someone attempting to take your handgun was a deadly force threat. Now officers getting killed with their own handguns is relatively rare. |
