Legal on pre or post, unless you are in a state like CA that restricts some scopes.

You can mount them on anything you want.
Various states have various things to say about what you can shoot with them when and where. In California you can't have a NVRS with a built-in IR illuminator but you can use an external illuminator...

just don't get caught with it in your vehical during a big game hunting trip.
