I have a lower receiver I want to register as a SBR and want to file the paper work with the ATF. However I'm moving in about four to five months as my new home is  currently under construction.  Will this be an issue?

How are you filing, as an individual or a trust? Will you be in the same city? You will need to engrave the item with your or your trusts name, and city and state.

As an individual and we will be in a new city. Should I file as a trust to get around this issue?

The biggest issue is they send your approved or disapproved form back to you in the mail to your mailing address, and the USPS will not forward mail from the ATF, so if you put your current address and then move before it's returned, you'll never know the result and your stamp may get lost.

IMO, wait until you move and have your new address lined up. 

As for the engraving, the city and state you engrave should be the location where you actually complete assembly of the NFA item.  It does not need to match the location on your form 1.

I believe the form says to include additional markings such as the maker's name (OP or his trust), city, and state. I'm pretty sure your lower's marks need to match those on the form.

Name yes, either the individual or the entity (trust), depending how filed.

But the city and state engraved are where the NFA item is made.  The city/state on the form (in box 3b) are supposed to be for the address where the item will primarily be kept or stored.  They do not need to match.

See below.  Remember in the case of a form one filed by a non-FFL holder, you or your trust are the "Maker".

§ 479.102 How must firearms be identified?

(a) You, as a manufacturer, importer, or maker of a firearm, must legibly identify the firearm as follows:

(1) By engraving, casting, stamping (impressing), or otherwise conspicuously placing or causing to be engraved, cast, stamped (impressed) or placed on the frame or receiver thereof an individual serial number. The serial number must be placed in a manner not susceptible of being readily obliterated, altered, or removed, and must not duplicate any serial number placed by you on any other firearm. For firearms manufactured, imported, or made on and after January 30, 2002, the engraving, casting, or stamping (impressing) of the serial number must be to a minimum depth of .003 inch and in a print size no smaller than 1/16 inch; and

(2) By engraving, casting, stamping (impressing), or otherwise conspicuously placing or causing to be engraved, cast, stamped (impressed), or placed on the frame, receiver, or barrel thereof certain additional information. This information must be placed in a manner not susceptible of being readily obliterated, altered or removed. For firearms manufactured, imported, or made on and after January 30, 2002, the engraving, casting, or stamping (impressing) of this information must be to a minimum depth of .003 inch. The additional information includes:

(i) The model, if such designation has been made;

(ii) The caliber or gauge;

(iii) Your name (or recognized abbreviation) and also, when applicable, the name of the foreign manufacturer or maker;

(iv) In the case of a domestically made firearm, the city and State (or recognized abbreviation thereof) where you as the manufacturer maintain your place of business, or where you, as the maker, made the firearm; and

(v) In the case of an imported firearm, the name of the country in which it was manufactured and the city and State (or recognized abbreviation thereof) where you as the importer maintain your place of business. For additional requirements relating to imported firearms, see Customs regulations at 19 CFR part 134.
