I saw an 11.5 inch upper at a gunstore today. Can anybody just buy one? since it isnt a whole gun. He didnt say there was any permits required to buy it?! Was ist das?

You can buy one.  No permit required to own it.  But if you put it on a lower you have to register it as a short barreled rifle.  $200 tax stamp, fingerprints and all that crap just like you would if you bought a machine gun.

it is legally classified as a part or assemblage of parts that does not constitute a firearm. so yes
BUT
if you mount that 11 1/2 in upper on yore rifle it lagally becomes a pistol subject to regs conserning such.
