Wasn't it soon after the Fed reserve was created. Yes, the Fed needs an income tax. Without it, a debt based monetary system is impossible. Get rid of income tax, the Fed can't survive. The income tax feeds the monstrous medusa head that is DC or the Federal Level of government in the US. As as said above, it never passed. There were two few votes needed. The 16th Amendment didn't actually legalize income taxes. We had income taxes before that. However, the Supreme Court had held that income taxes had to be apportioned by state. The 16th Amendment made it possible for federal income taxes to be levied uniformly throughout the country, without regard to apportionment.

It was then sent to the states for ratification, and at least 3/4ths of the state legislatures voted to ratify the amendment. Article V of the Constitution outlines the process. It also outlines the process whereby the states can bypass Congress and propose amendments via a convention of state delegations (like repealing the 16th and/or 17th amendments). The ratification process would be the same whether the amendment is proposed by Congress or a convention of the states. |
