| I don't know what the PA law is either, but if the published rules are that if you leave w/o sufficient notice you don't get your vacation pay, I'd say you're screwed unless state law contradicts explicitly. Had you given two weeks notice and the company invited you to leave immediately, that's another story. |

I think you should get a lawyer and sue these bastages. But first contact the PA Wage and Labor Dept. or what ever constitutes that in PA. I think they are gonna be in hot water. If it is earned, then they can no more refuse to pay it, than they could refuse to pay wages. |

Here's a .PDF that explains Pennsylvania's law regarding Wage Collection. Pennsylvania finds "use it or lose it" clauses to be acceptable, and does not classify unused vacation or sick time as wages owed. Link to PA Law |

That sucks, and that double-illegal-sucks if they did it because you joined the reserves. I would look through any paperwork you might have, perhaps an employee manual? After reading the law it would appear that they technically don't owe you anything, but they should have made that very clear at your hiring date. If your assumption is correct about the reserves, try to find a way to back it up and get an attorney and your local news involved. Sorry to hear you are in this position, good luck. |

I suggest you have your lawyer contact the HR department directly. If indeed you were involuntarily terminated, it looks like you are entitled to your vacation pay. I would also refer the HR Manager to a community college for a course in business communications. There are a number of egregious spelling and grammar errors in the quoted message. Inexcusable. |
