Do you fight it

Lesson: don't blindly pay legal looking shit.

Edit: Speed Camera, not a Red Light Camera.

The People's Republic of DC sent me another one yesterday. $150 for speeding at 41 in a 25 on South Dakota Avenue. I remember driving that fast there on that particular day... The only problem is that I was in fact doing 41 and accelerating on the on-ramp between South Dakota Avenue and E Hwy 50- where the speed limit is 55. I totally disagree with the ticket, but I haven't decided whether or not I'll pay it yet.

I hope DC sinks into the swamp it was built on.

DC? I used the following site to get out of a DC ticket a while back:

IT WORKS.  Site says its for traffic tickets like yours too.

Iirc, you send them a copy of your ticket and they send you back a PDF with dozens of legal arguments why DC is required to dismiss your ticket.  You print it out, sign it then (this is important) send it by return-receipt-requested mail.

Those all got removed from the town I lived in back in Ohio because they basically just sent you a conviction in the mail.  Some ambulance chaser got the entire company thrown out because he said there was no due process.

The system they were using was just for money, the company who owned the cameras got 1/2 and the town they were installed in got the other 1/2.

That happened in Chattanooga TN years ago.

Some kids stole license plates from cars similar in make, model and color to their own. Replaced their tags with the stolen ones then proceeded to run every traffic camera several hundred times over the course of a night. Then replaced the plates on the cars they took them from.

They did this several weekends in a row. It caused such a nightmare in traffic court.

They were finally caught one weekend when a cop witnessed them running a redlight and stopped them. He discovered the plates didn't match the VIN on the insurance information, began to dig and the teens admitted to what they had done.

I got a couple speeding camera tickets in DC years ago. I did some research, the DC courts have tied themselves into jurisprudential pretzels to allow it, so no point in fighting those. I just paid them. $50 and no points on my license, I have better things to do than worry about that.

They are a money making scam for the city. My mother received one, didn't even state what she was receiving a ticket for, you just get a couple snap shots of your vehicle at an intersection. We fought it, I had to guess what the actual infraction was, they reduced the ticket 50%. They never commented on what the infraction was. It's a scam.

I'd imagine that they're illegal just about anywhere that has a crayon-picture understanding of the Constitution.

DC does not. This is merely one manifestation of the phenomenon, which is even more ironic given that the original document is housed there.

There was a shitstorm in Maryland a few years ago over these. Every picture was supposed to be examined by one of the traffic cops, checked for validity, electronically signed, and sent out.

Then somebody realized that one of the signatures was of a cop who had died from a heart attack the previous year.

They had another one with some speed cameras there, they were taking photos of stationary cars at red lights, and saying they were traveling over the speed limit.

I'll check it out, but like dbrowne was just saying.. The DC court system doesn't always care about upholding the law, they just want their money.

I'm about 90% sure that you are not even entitled to a court hearing for DC camera tickets. You are instead given an "administrative review" and the administrator decides whether or not you still have to pay your ticket. Traffic tickets are really just a tax in the eyes of the DC government.

Hearsay is not admissible evidence unless it falls under an exception allowed under the rules of evidence.

In order to be considered, the proper foundation needs to be laid by an actual "witness", meaning a person who testifies in court because you can't cross examine a photograph.  Due process requires that you be able to examine a witness against you.

It isn't necessarily that a photograph lies but there can be other issues as a photograph can't testify when it was taken or that it hasn't been altered.  True, they can superimpose a date on it but who is to say that the date on the machine was set correctly?  Anyway,

My girlfriend's mom called me the other night asking about this very thing. She got one in the mail Monday for going through a stop sigh on Long Island. Now, the car in the pic isn't hers, the license plate isn't hers, and we live a solid 90 minutes from the city. I told her to call the contact number on the ticket and tell them to run the plate. They'll see that not only is the car not hers, she's NEVER owned that kind of car before (a Dodge Charger.) It's weird that the ticket was mailed to her because they own a Dodge Dart and a Ram pickup, but everything else is wrong and they DO NOT go to that shithole. EVER.

I know the one... Maybe a week ago I literally had to lock up my brakes from about 12-15 over to avoid getting ticketed from that camera. You don't see it and it's at the bottom of pretty steep hill.

Personally if I ever get another one I'll fight it. In this state they have no legal standing. Instead the cameras are run by a third party company and and the tickets are sent on non governmental letterhead. Why? Because there is a LAW in my state that prohibits law enforcement from using any pictorial or video evidence to charge or ticket any person after the fact. So, to have a red light camera ticket on police stationary sent by certified mail, in my state, would be illegal. all I have to do is quote that law, challenge them to provide me with my accuser in court, and demand they prove beyond a reasonable doubt that I have committed any crime.

I should pull mine out (no, not my penis). I got one while driving an ambulance. I wasn't going Code 3 but I had a patient in the back. No traffic and I wasn't going to slam on the brakes.

My ambulance company put it all on me so I said fuck that and didn't pay. They sent it to a collection agency and I think it's up to nearly $800. Don't live n that state anymore so fk them.
