I saw this ad on a site. Is it copyright infringement? Is the BFL trademarked? I remember hearing a while back that it was.

That one appears to be different enough from the sites that I don't think a copyright infringement would hold much traction.

They're in the same market space as arf, and the BFL is obviously not only a prominent feature in that graphic, but it would be pretty easy to show that they're benefiting from it being similar to arf's logo. They'll get loved tenderly.

So if a company uses the bfl and makes money it's copyright infringement if they didn't get permission or buy the rights to use it..and when we buy the bfl items and display it, it's fine I get that but what about tattoos does that count as copyright infringement? (No I don't have one just seen it)

The tattoo artist is earning money on it. To expand on Drok's question: What if a tattoo artist presents the BFL as one of the designs he offers? For the sake of the hypothetical, I'll establish that he would not take credit for creating it- just offer to tattoo it on people.

No--I sent a link to an Admin (Avila) and that's the last I hear of it.  I'm GUESSING he sends it to a site attorney and they deal with it.  I have no idea how long it takes, but these things tend to be rather mundane--use an idea until you get a "cease and desist" letter, stop using it, promise to not take it back up, and it ends.  There's no fireworks to report--things are just handled.  

As the site MUST defend its copyrighted items in order to maintain the CR, obviously they appreciate threads of this type.

       I mean if I had the bfl tattoo and didn't get permission to use it, no earnings for it. That still infringement?  
      As to the op post Yea that's a close one just because it's part of a design. Looks like a fine line on that one.
