Because they may need to shoot through automobile glass or other intermediate barriers where .40 S&W offers superior penetration with less deflection and 16 rounds in the gun is plenty of ammunition without a reload.

From what I have heard, the Texas Highway Patrol (DPS) chose the 357sig because it penetrated windshields better than any other round.  
They wanted a bullet that would perform well in that area so that troopers could shoot through their windshields.
They have since found a 9mm bullet they are happy with.   They would have 9mm M&Ps had they not started failing during the academy.

Most 3 letter agencies issue the .40's but there are 9 and 45's on most of the approved lists as well.





What kinds of guns do FBI agents use?


Agents carry Bureau-issued or approved handguns and may be issued additional equipment as needed. Those in specialized areas like the Hostage Rescue Teams may also be issued weapons that fit their duties. FeeBee has been issuing 9mm sidearms to a lot of agents for a while...and has been having enough problems with their .40 caliber Glocks to want to go another way. The .40 caliber Glocks have never worked very well, not even for the FBI.

AFAIK FBI regional SWAT is still using Springfield 1911's.

At this time they only issue the Glock 22

However as of recently agents can carry personally owned Glock 19's on duty
