I actually think it is a worse problem than drinking and driving just because so many people do it. You can always tell the ones who are doing too, they are going slower than the flow and are swerving. I am to the point where I honk at them they piss me off so much.

When you have people texting and killing as many people as drunks, then we should be concerned and have equal penalties.

Do you think being caught texting and driving three separate times should be something with a mandatory prison sentence?

Dude, I have no idea!

As stated there are already laws prohibiting it and they clearly do not work so additional bans and prohibitions will not solve it. The other problem is that what would prevent a driver from doing it would also prevent a passenger so that won't work either.

I guess it just comes down to personal responsibility.

I do agree that if you cause an accident because of texting, the penalty should actually be more harsh than a DUI.

Sober texting while driving you are willingly grossly endangering those around you. You can get a DUI for 2 beers and not be near as dangerous. You are actually choosing to not look where you are pointing your deadly weapon, yet you would lose your shit if some pointed a loaded gun at you.

What is the difference?

I also used to, but I quit when I got a smart phone. With my dumb phones I could feel which button I was sliding my thumb to and still look at the road for the most part. I can't feel the buttons anymore, so what I'm trying to say comes out completely wrong, and its safer not to, so I just quit.

You really don't see how putting people in jail for texting while driving would necessarily lead to all sorts of new laws for eating while driving, changing the radio station while driving, checking for boogers in the mirror while driving, adjust your balls while driving, etc.? It's a terribly slippery slope that I don't want to see us slide down. A free society is not a safe society. Suck it up.

Brad, you will get yours.  The older you get the less you realize you know.
Explain this to me.  You want to communicate.  You have a device that you can communicate on with your voice, like talking to a passenger, with both eyes on the road.  But somehow, communication is better by taking your eyes off of the road, and typing in broken sentences to try and communicate.  How does that make sense when you could use your voice to communicate, or use a voice to text feature to do the same, allowing you to keep eyes on the road/surroundings?  Why do texters insist on not watching what is going on around them and insist it will be okay?  Hopefully soon, cars will be automated, and can be set in a cruise mode where they drive themselves safely  if desired, so distracting tasks can be performed safely while traveling.

There are already laws against it. What can be done in your estimation?

First Offense - Felony, automatic license supension for one year, optional jail time for one year.  $1000 fine.
Second offense - Felony, mandatory five year license suspension.  Minimum one year to three years in prison.  $5000 fine
Third offense - minimum five years in prison.  License revoked for life.  $10,000 fine

Death or serious injury would add vehicular homicide to the aforementioned texting charges.

In other words throw the book at them and make a damn huge book!

Nope.  Those people have to get off the road.  I can't think of any other way to do it other then suspending/revoking their license big ass fines or prison.  When someone you love gets killed by some idiot texting on the freeway you'll get it.

but then it's too late.

No shit.   I bet if they did increase the penalties you might well see some push back from the citizens.  Texting has become ingrained in current society and it would be like prohibtion.  Which it is anyway.  Most people ignore the law banning it while driving.

It is proving a hard law in KY at least to enforce.  Alot of judges have dismissed the charges because the Officer cannot really prove the person was texting.  Not everyone texts where the officer can see them doing that and the person can claim they were not texting but doing something else.

A local TV station interviewed me Tuesday. They are doing a weekly report on the dangers of Distracted Driving.
I talked about the death of my son Cody. Someone called him and he answered the phone, went through a red light. He was 19.
Anyone who thinks they are a better driver while txt'ing or talking on the phone is a fool.

That's a very sad story and I'm sorry for your loss but the brain isn't developed until 23 or 24 yrs old.
I don't quite get the argument that he took 0.5-2 seconds to slide the answer bar on his iPhone to answer a call ----> missing the yellow, missing the red, cars already accelerating, getting t-boned.

Clearly, the laws for 19yr olds don't apply to the rest of the general populace ETA: we are not all created equal. Some people can multitask, some can't

"Anyone who thinks they are a better driver while txt'ing or talking on the phone carrying a gun will allow you to stop a violent criminal in public is a fool"
FIFY

ETA: Again, very sorry for your loss

ETA: who do you blame? The firend that called? The phone manufacturer? the service providor? the car manufacturer? The safety institute that said the car was crash test rated? God for allowing the perfect storm to take your child? Do you blame Cody for being irresponsible? Do you blame yourself for not teaching him/warning him more thoroughly?

I read most of what you said.
I posted this earlier in the thread

autocorrect on smart phones, you're not texting the CEO or a senator. A gramatical error or spelling fubar is fine.

Voice to text

ETA: I'm not sure if I wasn't clear earlier - if you have to take your eyes off the road for more than 2 seconds to text, you're a 16yr old girl (or 60yrd old)

Distracted driving has been a causative factor in traffic collisions and traffic related fatalities long before the advent of the cell phone. Since cell phone use has become widespread we have not seen a spike in traffic collisions or traffic related fatalities. So, why the sudden urgency and "need" to ban cell phone use while driving? Why not ban eating while driving? Or how about putting on make-up while driving? Bans on cell use while driving is a typical statist move to address a symptom not the disease. It is no different than the left believing a ban guns is a solution to curbing violence perpetrated with a firearm.

A "common sense" approach would be that if someone causes an accident due to distracted driving, regardless if it was due to using their cell phone, trying to smack their kids in the back seat, or getting a BJ while cruising down PCH at 55 MPH, the penalties should be no different. Also, DUI is illegal and look how well we as a society have curtailed that problem.
