http://www.chron.com/cs/CDA/printstory.hts/topstory2/1540867 It's always nice to have the whole story. Raid went to 'hell in a handbasket' Officers say Kmart bust was flubbed By S.K. BARDWELL Copyright 2002 Houston Chronicle Houston Police Chief C.O. Bradford ordered an investigation Monday into the weekend arrests of hundreds of people gathered peacefully at a westside parking lot by police who were assigned to stop illegal drag racing. Officers on the scene called the arrests "utterly, utterly senseless" on Monday, and said the captain in charge, Mark Aguirre, ordered them to round up everyone who was outside the 24-hour Kmart Super Center or eating at the Sonic Drive-In next door. The operation had been weeks in planning and involved dozens of officers. But officers involved said that when no drag racers were found, they were ordered to arrest the 278 people there. .......... "I vas jes followink orters!" If the cops there are that willing to carry out "utterly senseless" arrests, what is going to keep them from doing "utterly" unconstitutional gun confiscations? That whole department needs to be sued out of existance and those officers involved brought up on charges of civil rights violations, false arrest, kidnapping, and abuse of power under color of authority. |

That department is worse than the daytime soaps my wife watches! Holy shit! "There are all those kids now, who have a criminal record, and don't deserve it," said the other supervisor. Yes, and that could majorly affect their chances of getting into certain colleges and even working, if they are over 18. What a joke! Man, I would sue to get the conviction expunged. What BS. That captain sounds like a real piece of work. So what is the end result? You have the city and the tow yards making a small fortune in vehicle impound fees, jail processing fees, whatever, and you have 400+ kids who will remember this event for the rest of their lives and how they were treated by the HPD. That's real good PR, sure is. Teens have always needed a place to hang out. When we were kids, we congregated on "Main" street downtown, or at the local Taco Bell, whatever. But no teens were ever arrested for doing what teens do naturally. It's just amazing. |

shhhh its still under raps. my dad is working on the case for Sonic. as you know the sonic property is in the kmart parking lot, and police arrested everyone at the sonic too. well my dad is sponcered by them to do antigang presentations at schools and such, but they also hired him to do a investigation. my dad and i went over there to see if there were no tresspassing signs, there arnt. by law, there has to be a sign, or the manager has to come out and tell the people to leave and give them fair warning before the people can be arrasted by the police. anyway...i will sneek details as i hear them from my dads P.I. firm. heeheeh |
|
YIKES...this all happened on my vacation and I just now heard about it. My patrol district is in this area but I work for the county not for the city. I want to say that there are "no trespassing" signs at the K-Mart but it's been a while since I've been there and I might be wrong so I can't say for sure. I can say that we do have tons of problems on weekends in that area with the racers and the kiddos hanging out past curfew. All I can say is that I'm glad I didn't have anything to do with that. P.S. HPD chief C.O. Bradford and the captain in this case are basically in a pi$$ing contest between each other because the captain has filed several complainants against him and the police chief has been under investigation for perjury as a result of this captain. Also the captain in this incident was involved in a accident on duty a few nights ago and the police chief sent a asst chief out to the scene to make sure no alcohol was involved. That's not done for regular officers so it makes me believe it's a result of the pi$$ing contest between the two. But I could be wrong about everything so take it for what it's worth. |

Quoted: I want to say that there are "no trespassing" signs at the K-Mart but it's been a while since I've been there and I might be wrong so I can't say for sure. Even if there were "No Trespassing" signs at K-Mart or Sonic, it does not give the police officers the right to arrest anyone for "trespassing" since the businesses WERE OPEN FOR BUSINESS, and especially since they are open 24-hours a day. That would be similar to me posting a sign at my house, and inviting you over to my house for dinner. Can the cops bust into my house, without a request from me, and arrest you for trespassing just because I had a sign up??? Isn't it up to the owner or, the owner's representative of said property, to actually request that the trespassers be dealt with? |
|
Quoted: But officers involved said that when no drag racers were found, they were ordered to arrest the 278 people there. And how many of them refused to obey a clearly unconstitutional order?? How many took a stand?? You people who think cops and military will refuse "orders" to disarm you should re-think your position. This incident, like ones such as waco and ruby ridge proves that hypothesis totally wrong.... |
|
Are all Texan cops mindless drones working at the behest of complete imbeciles? This shit would never happen in NY, cops are required to have an education here and they also have a pretty good understanding of our constitution. A kurfew? Fucking ridiculous! You TX people should demonstrate for this one, or are you going to just let the police bend over these kids? Holy shit, my mind is realing from the stupidity I just read! |

hey guys .. i live here in houston... the area mentioned in the raid has been a popular hang out for YEARS with kids..when i was a teenager we went there...granted not all of the people were innocent of any crimes the night of this raid ,but neither were they ALL GUILTY either..cops are using the excuse they were just following orders( ala 1938 in europe ) but a few did not.. there is a very small number who refused to follow thru with the raid and were told they would be fired...havent heard yet what happened to them ,, k-mart denies the complaint came from them.. several of the other business denay that they made the complaint.. and hpd says they(the police dept.)cant make a criminal tresspass arrest without 1st having a sworn complaint from the property owner(S) and also the kids were not told to leave the PUBLIC parking lot before they were arrested.. the absolute best part of this are the people who were arrested in the SONIC parking lot... a 10 year old girl wasarrested in front of her dad for.... curfew violation(at a 24 hour business with her family present) and criminal trespass..10 yrs old and she WAS put in the nylon cuffs.. she might be armed and dangerous.... another person arrested has k-mart receipt for almost 200.00 dollars worth of merchandise ..checked out of the k-mart at 12:43 and arrested at approximately 1 am..hpd says she "ducked in to the k-mart to avoid being arrested and boughta cople of items" the couple of items include parishable groceries and persanal items..not chewing gum and a soda as they initially claimed... again i will say that noy all were innocent ..but not all were guilty either..capt'n aguirre (raid leader) attitude was "arrest 'em all" ....is that even legal here? is it right anywhere? is he practicing for his U.N. peace keeping roll of J.B.T. rounding up the people on his list? i'm just sounding off.. sorry for the long post john in houston |
| wow, too cool, when i was grabbed and arrested for being at a resturaunt eating, whew, i guarantee i would have fought tooth and nail to resist the illegal and unconstitutional arrest, i would have been beaten by the thugs, and would have been independantly wealthy, police would have been fired, and arrested for kidnapping, oh yeah, me on the news, "can't we all just get along" |

If that's true, show us proof of the trespassing notice (i.e. being asked to leave) each "guilty" person received before they were arrested... hmmm... |

Quoted: [red][10 years in the future][/red]when no illegal weapons were found, officers were ordered to arrest everyone at the gunshow[red][/10 years in the future][/red] It's not that big of a switch folks. Except I doubt it will go as peaceably as arresting children in a parking lot. No rights gains were ever made without resistance. |

And when they're put under the gun, they lie. Gotta love that department. |
