If we can keep this from being a purse slinging match I am curious to know what the 'do's and don'ts' of going through a DUI checkpoint are.



What am I obligated to do?  What am I NOT Obligated to do?

We don't do them in Texas.  If you leave, every state is going ot be different and you'll have to ask state by state.

they're not legal here in Iowa, but safety checkpoints are. Wear your seatbelt,produce your license,registration and proof of insurance and you'll be ok.

Yep, Federal Land.  No Texas Po Po involved.  They do it a lot on Military bases too.  Ft Hood does it practically every weekend.

I find it funny as hell that they are boasting about arresting 59 DWI's a year.  We do that in a weekend.

If it is a DWI checkpoint, the narrow scope is searching for drunks.

Just pull up to the officer and stop. Have your window down. He'll probably ask you some usual questions. He is looking and trying to gauge whether or not you have been drinking. He might even come out and say it. If you are super short and nervous with your replies, he may have you pull over to the DWI check area. He'll talk to you more and probably pull you out of the car and do a field sobriety test if he thinks you've been drinking.

Just be nice and respectful and you'll probably just get a wave right on through. He just wants to get you talking enough to smell alcohol or to see if you are or aren't slurring your words.

In Ohio, they you are allowed to avoid the DUI checkpoint, and they are not allowed to pursue.  



Also, the they post where they will be about 24 hours ahead of time, so if you wanted to look it up before you go drinking, you can.

The thing about dui checkpoints, is not to go through them.

If you do have to go through them, roll down window just a little, stick DL and such through, wait.

Don't say shit.

Just fucking wait.

DO NOT DO ROADSIDES, they are designed for you to fail.  

At least here, listening to a lawyer on the radio this AM, it is better to take the blood test rather than the breath test, but NEVER do a roadside test.

Don't talk

If you are over .08, better to just take the 1 year DL suspension than get popped for DUI, so decline to be tested at all and give up your DL.  It's cheaper, and you get it back faster, AND you don't have to get an interlock (mandatory here now if above .08).  Now, if the officer can pop you for DUI without the tests, then IDK.....

Now, that was a lawyer that I was listening to on the radio.  She's been on the show for a while and gives minor advice out over the radio in order to get publicity for her firm, so I doubt she would put her firm's name on bullshit..............that she didn't advice people to do on a regular basis, because it would just come back to bite her........

Understood.  I don't drink when I fish on the surf...no way I'm going to be impaired and potentially deal with big toothy fish...your answer is pretty much what I will do...I was more asking the theoretical...what am I REQUIRED to do?

That's a fact!  I'm getting a lot of use out of this pic lately.  A previous safety checkpoint - they always announce them in advance.

Agreed.  Like I said...I don't drink when I'm surf fishing, and am old enough to know better now...and I have plenty to lose by doing something stupid.

 



Besides...being on a beach, surf fishing, in 95-100* weather and drinking alcohol and getting dehydrated does not sound like my idea of a good time.

Got stopped at one a few years ago. NOT drinking, out late at an animal auction.

1. Do have your license, registration, and insurance available
2. Do be polite to the officers


3. Don't open the glovebox to retrieve above items and have your wife's pistol fall out on the floor while officers are looking in both windows watching you.


4. Do have them laugh at you, check your stuff, and wave you through.
