k..not going to go deep into the back story....wife has a student loan {before we got together} she hasn't paid on due to loosing my job and her's right after I found new work. She is working now....
  That bill was not on my priority to get paid....Power/water/house..ect were.  She JUST told me that the collection agency that  has her loan sent a letter saying the will garnish her
pay if she doesn't workout a plan with them....their plan..access to our fucking bank account!!!! She F'n gave it to them so they can take however much out of our damn account!!!!!!  

 I got fucking LIVID over that shit, told wife she can either call them OR the bank and close ANY access to our account or I will close my account with our Cred. Union!!!! I have been with my Cred. Union since 2005..I brought my wife in on it after we got married....I am sitting here shaking right now over being so pissed of...

  I don't know if a collection agency CAN garnish wages or if that was a BS threat or what....I can't remember if I have ever yelled at my wife like that...I don't want ANYONE having access to my fucking account like that, plus the bitch...{cough ..wife} didn't even talk to me or tell me about it until AFTER the fact!!!!!!!!!

 She's actually pissed at me, telling me weather she sends them a check or them taking out of my damn account is the same thing.......NO the fuck it isn't!

 Am I wrong here????!!!!!!

'til death do us part' is a long time brother.  You have a right to be upset if you run joint finances and she didn't discuss this with you.  But consider it a mistake on her part, a learning experience for her, and do what you need to do to rectify it and move on.  Like you, I would have a serious issue with any third party having access to withdraw funds from my account at will.  A payment plan that was a scheduled "auto-draft" of a fixed and agreed upon amount would be acceptable though.

They're going to wipe your bank account clean.  My guess is, the people your wife got the loan through hired a collection agency to collect the unpaid balance.  These people will do whatever it takes to collect.

On a side note, student loans aren't bankruptable.  They WILL get their money one way or another.

ETA:  You have a right to be mad, but I don't see where this is life threatening.  Have you and your wife considered some type of financial counseling?

Without a court judgement, I don't think a collection agency can legally garnish your wife's wages.

But now that they have your banking information, don't be surprised if they rape your account at free will.

Don't be too mad, yeah, giving up the bank info was stupid but all you do is call your bank and tell them your account information has been compromised, which it has been, and they'll secure your funds.  Collection agencies say all kinds of crazy shit to try and scare and intimidate people into paying - we'll sue you, garnish your wages, kick your dog and spit in your food, key your car, etc, and all too often it works.

When your debt goes to collections, if you choose to pay it, do it only with a postal money order.  Never, ever give them anything that has your banking information on it, 'cause they'll help themselves to whatever the fuck they want - been there, done that, got the bank statements to prove it.

Garnishment is one thing. Freezing an account is another.

I don't know what is allowed by law, but it sounds like you need a decent attorney that can handle all that for you.





You, and your wife, need to work on the more pressing lack of communication issues you two seem to have.

 Either way...
1- she should have talked to me 1st
2- I don't like/want ANYONE having access to my account.....reason being, her car place has double dipped into our account a few times before I put a stop to that a while ago

No, you're not wrong. I won't ever give anyone permission to remove money from my account under any circumstances no how no way ever. Too much room for errors and mistakes that can screw your account up. I would call the bank/credit union and remove any authorization to do so asap.

Open another account in YOUR name only, take 50% out of old account, place 20% in new, hold other 30% in cash until it blows over to make sure they don't try to seize your account. Put all your money in new account, do not mix funds. Split bills equally between accounts. Add to your cash holding with a portion of your earnings [if you have any] She needs to check her balance daily or before she writes out bills.

And yes, they can and will garnish accounts or earnings for student loans and they will seize tax returns. If filed jointly, good luck with getting your portion back if they do.

If the student loans are federal in nature or purchased by them,  she had better deal with it, a lawyer may get her more time but that is about it, she is NEVER going to get away from them, they will still go after her after she retires and trying to get them discharged is a waste of time and money.

Sounds like your wife doesnt "get it".
You sounds like your taking the Dave Ramsey approach- paying yourself first, no giving access to the bank.
Id sit down after a cooling off period and explain exactly what she has done, what the collections agency can now do, and what the end results will be.

Too many people get scared and give into the demands of collections agencies. Yall dont sound like your trying to skip out- your just in a bind right now.

Id also take the time to make sure your on the same page on other important things. People always assume the other party knows things that you do.

Yeah , she's stupid for giving out the account info, but you'd be just as stupid to think that they can't get that information without a little bit of work. Go work out a plan with them ,move your accounts, get it paid down.

#1.   They can't garnish without a judgement...did she get served?   Is there a judgement?   Collection Agencies are notorious for lying about stuff like that.    

#2.   Contact your credit union.  "revoke" any access by outside individuals.   Send a certified letter to the CA about it.

I don't know if you are wrong in your concerns, but you are blowing it way out of proportion.  If you disagree with your wife's assessment, just open another account and close the old one.  Tell the bank it's a security issue if you want to.    It's free and easy to change accounts and to change banks, so there is absolutely no reason to be shaking with anger.  That is just some bullshit mis-directed emotion that probably has little to do with the issue at hand.  



A big mart of being a man and a husband is just fixing things without making a big drama out of it.  It's your friggen wife, dude.  If that's the worse thing she ever does, you will be a lucky, lucky man.  



You definitely should be making some token payments, so she is right about that part.

I agree with billofrights to not make that big of a deal out of this. My wife's pretty smart, more than me but that ain't sayin' much, but somehow she got suckered into giving out her e-mail password last week to some "chat service" one of her friends joined. No big deal I had her change the password and removed the spyware it installed, no point in flipping out over it, lesson learned.

At this point, short of divorce, I'd cut her off from all funds and access, period.

My ex owed around 6k in student loans.
Didnt pay. Didnt pay. F them Im not paying them shit.
Well for years they kept adding interest and collection fees.
Well she was shocked when they started garnishing her wages and got a bill saying she owes I think it was 23k.

They threatened her with garnishment and or legal action? Sorry but I would be getting in contact with bank and changing the account yesterday.  Contact AG due to illegal collection practices, ie. threats of garnishment and legal action are a no fly zone.

And they can seize any bank accounts her name is on, and put a lien on their house if it's jointly owned, seize vehicles, a judgment is a pretty big deal, at least in some states.

Like I said, I'm with you.  I'd be mad too.  But consider the health of your marriage and that she was probably received and gave into considerable pressure to do what she did by some collector threatening God knows what.  It's your job as her adult, mature husband who knows better to work with her to fix the situation and come to an understanding about how to protect your joint finances.

In 3 months this will be a non-issue, so is it worth stressing over?
