hypothetical here , if you were to hurt, maim, or kill someone in a sleep walking episode would you be legally responsible ? if yes why and how ? if no why not ? i dont know if this has ever happened or not. just a random thought ?

There have been cases where people used this as a defense, I think it failed. The case  I recall was in Arizona I believe.

was it really sleep walking or just a defense ?

I think it would be hard to prove that you were asleep at the time.

If this were a common thing, there are a few people who I might punch in the face, then look disoriented and ask where I am.

well we have all heard about folks takin a drive on ambien. so lets say for discussion sake that it was a documented sleep walker
