G/F's dad works his ass off... usually 60 hrs a week. Now he has cancer (not work related).

FMLA offers 12 weeks. If he has 4 weeks of vacation saved up and 4 weeks of sick time banked because no vacation or sick time has been used in forever, does that mean he can have 8 weeks paid and 4 weeks unpaid leave or 8 weeks paid and 12 weeks unpaid? We are all worried that 12 weeks won't be enough for all the chemo and radiation, but 20 weeks would be more than enough. It would suck if they just fired him after 12 weeks if he needed 15.

I was under the impression that FMLA kicks in after all types of paid-leave are exhausted. In the case of this man, it would be 8 weeks paid and then an additional 12 weeks of leave. Don't forget short/long term disability payments if that is something he has.

Each state is a little different, check into it. In oregon, my wife got an ass load of time of for maternity leave. Short term disability is something to look into also.

IIRC FMLA only secures his employment, not the pay schedule.

At my company you have to use your paid time before you use the FMLA.

Let me add that FMLA is without a doubt the most abused program I have seen in my 20 year career.
