So I started this new job about a month ago.  Turns out the job didn't work out.  I call and they tell me when to get my check.  I go in today and they give me the run-around about it not being processed yet and to call on Monday.  It's obvious to me that they are stiffing me out of a weeks pay.  I don't know what kind of business this guy is running, but from what little time I had there I noticed several employees returning to get their paychecks fixed.  Always short.  Should I just forget this or try to get paid.  I mean what can I do?

im not an expert, but look into a state workforce commisision or something similar.

eta maybe get the irs involved.  "something isn right with my w2."

Look up your state government website. It should have a link to your state's department of labor. The state will hammer an employer for failing to pay wages.

this is a FLSA violation to "hold" your pay check

that said depending on your state they can wait untill regular payday. If they use ADP its expensive to cut manual checks

i would give them the benefit of the doubt since this sounds like the first run around and call monday.



THEN if that check isnt ready I would inform this former employer that I am calling the appropriate channels of the state to report them if that check isnt ready for pickup in 1 hour.



If not, call made.

If your state labor board is anything like ours its a waste of time. It takes longer, but get the Federal Department of labor involved. They can assign an investigator to check their books. Been down this road before.

If they stiff you for your check, it's paper time.

One of the niftiest things I've learned about making a complaint is to send it via certified mail. Explain what happened, explain that you can document your time there, and tell them that if you aren't paid by  xxx date  you will take legal action.

DO NOT make threats. And don't make an angry letter out of it, either, because that can be constituted as a verbal threat. Be businesslike and let them spin enough rope that they can hang themselves with it.

A previous employer got busted doing an "comp-time" system with OT.  It was completely voluntary on the part of the employee (I liked saving up time off) but still illegal.

Not much, enough to catch up with my car payment though.  I did do quite a bit of work the time I was there.  The thing is I had to record my own hours and was not in their system so to speak because I was being trained.  I had a bad feeling about this setup from the beginning.  I'm not doing this again.  I can go on a long rant about why the job didn't work out and then start blaming people, but in the end it really is my own fault.  But I still think I'm entitled to a paycheck.

We have had instance here where things went south in a big way with one former employee in particular. Even so, her time card was pulled and a check was cut for her full pay in a matter of minutes.

I did some consulting for a large firm that played all sorts of games with stretching payments out.

Only running checks once a week, always needing someone else's authorization, etc etc

At one point they went way out beyond 60 days & I threatened to stop working on the project. The project manager reamed me out for not being a 'team player' and hired some kid in to do what I was doing.

They still call with a job offer from time to time... NO THANK YOU

Call the State Labor Board, or your equivalent. I had an employer try that with me. I went to the labor board and the IRS. The IRS climbed up his ass with a microscope and camped out. He ended up owing almost $60k in back taxes and penalties for just one year.

I went for the check owed me and he wadded it up and threw it at me. I smiled and told him to enjoy his audits for the forseeable future.

department of labor. most states have laws about final paychecks. Here it is the check must be handed over as you let someone go if they quit you have 72 hours to get them a check.
