Ex wifes bf got arrested for failure to pay child support. He has no job and is on probation. She is freaking out and I have no answers for her so do anyone of you guys know how long some one gets lock down for failure to pay child support ? And before somebody says it its not the op !

Had an inmate working for us for a bit.  Not sure about the specifics of his situation, but he was enjoying a 60-day stay down at county.

Oh they should pay but the amount is something many disagree on. My children do not consume a 1/3 of my income presently but if I were divorced you can be sure the child support would meet or exceed that amount. Past a certain point you're no longer just supporting the children you're partially supporting the mother too which is bull shit.

I've seen several spend over a year in the jail.  They had to get a job during the day and stay at jail when they weren't at work.  They stayed until they got caught up.

Why does your Ex wife bring these problems to you?

To answer your  question it depends on the state and other circumstances.

ETA: In Iowa it is a felony so he could be in a while.

this is the truth. At one time I was giving almost HALF of my monthly pay. I have both my girls and about $200 bucks of month and they're good to go, and the mom doesn't even pay me child support. I filed to get her to pay like two years ago, and yeah she lives with her mom and they won't even touch her.

Because unlike a lot of cases we are still very good friends. She is also the co dependant type so now her man is gone. And she knows I won't bull shit her I will give her the best advice based on knowledge I have or will try to get her an educated answer or I will tell her flat out I don't know

If he was on probation and got arrested for not paying child support he will probably see out the remainder of the sentence that got him the probation in the first place.

Wow that sucks . My gf is on disability an ssi and even she has to pay child support

A friend of mine won custody from the mother after her third DUI (she had the kid in the car at the time of arrest). She had been shacking up with different guys and dragging the kid from home to home with her. While in her custody he paid her nearly $500 a month on one child. She pays him around $60 per month.

The best advice you can give your ex is to forget the deadbeat.  Unless, of course; she happens to have a thing for guys with criminal records, on probation, in jail,  that don't support their children.

Perhaps it's best to be short rather than four pages of arm chair family law practitioners telling you what they "think" is the case. My only advice is to refer her to an attorney. Like I said in family law and support cases there are too many variables in each individual case to give you a clear answer. It all comes down to the presiding judge in the end. Once again failure to pay support in Iowa (I'm guessing this is in Iowa) is a felony. He could be in for six months or six years.

Around here, it's stay till you pay, or the judge wakes up feeling merciful on a day that someone shows up asking for your release.

Depends on state and what he works out with the court. We have a "purge" amount he can pay (like 10% or something) as his bond and get out of jail. We don't have room for deadbeat dads for the most part, unless they are constantly trying to get over on the system. Then they'll get hooked for a while. He could also work out a deal for work furlogh to get/keep his day job.

I was 24K in arrears, but I worked out with them to pay the back amount. That was for two years at 1K per month for a daughter I hadn't seen since she was 1 year old. She's now 24 and I have a relationship with her and her mother can't do a thing about it.

I didn't go to jail and I'm currently working in LE.

I've known a number of guys paying child support in various amounts, but I know the details of only one non-support case.  The ex-wife would take the guy to court, the judge would order him to pay, he would pay for four or five months and quit, the ex-wife would take the guy to court, the judge would order him to pay, he would pay for four or five months and quit, the ex-wife would take the guy to court, the judge would order him to pay, he would pay for four or five months and quit, the ex-wife would take the guy to court, the judge would order him to pay, he would pay for four or five months and quit...   I knew her through four or five iterations of this, each cycle lasting around a year or a little less, as I recall.  

The ironic thing was that the money the guy saved by not paying support as well as the money the woman received as a result of the annual trip to court went for attorneys fees.  Great system, huh?

Right on, at least you're cool enough with her to be good friends, that's not a very common thing. Says good things about you. Sounds like she should have been cool to work it out with you since you are the one she turns to when things go sideways.
