AUSTIN, Texas – A Texas lawmaker says she plans to push for a law similar to Arizona's get-tough immigration measure. San Antonio Express-News and Houston Chronicle report Wednesday that Republican Rep. Debbie Riddle of Tomball says she will introduce the measure in the January legislative session. The new Arizona law would require local and state law enforcement to question people about their immigration status — and make it a crime for immigrants to lack registration documents. Riddle says if the federal government did its job "Arizona wouldn't have to take this action, and neither would Texas." Democrats say such legislation is misguided and predict it will hurt the GOP politically |

I was looking up who my state reps were since I moved recently so I could contact them about this issue, even better now. |

there are a few cities in TX that have tried it..
only to have ICE say.. HEY! stop sending us illegals.. Irving Tx is the first city that comes to mind. I suspect the same will happen in AZ.. they will make the arrest but ICE will start refusing to pick them up and they time out and get released. |

January is a long way off, for a problem that is here now, today.
Is someone trying to ride the coat tails of the public acceptance of Az? Can't some type of session be called to deal with it now? I appreciate it, as I am sure the rest of America does what she wants to do, but January 2011? |

One can hope right? to make that happen ICE needs to pick them up from the police.. ICE started refusing to pick them up and they started getting released. deportation was Irvings intent... then ICE mucked it up by not doing their part,., |

We don't have "year round" sessions (thank God!) Special sessions can be called, but that is up to the governor. This is still a "new" issue, so a special session is still not out of the question |

Hax I think this is a good idea too. I don't know how you would apply this law to the domestic help, gardeners, or home-depot type day laborers. I am not defending the illegal aliens one bit, but CBP, BPA's and ICE. There is something about US Immigration law that many here may not know.
If we enocunter someone that is illegal and has not been previously ordered removed by an immigration judge, our INA (immigration law) states that they have the right to plead their case to an immigration judge. A few things to note: -If there is minor children involved and no other parent, that illegal is not going to be detained while they wait. -If there are serious medical conditions, that illegal may not be detained while they wait. -There is also the matter of space, if the jails are over crowded or the local/ federal holding jails are filled and the illegal was not caught smuggling or being violent and was compliant, they may not be detained. -Case load. Take an illegal who was caught being here illegally or deal with an illegal that was caught smuggling/ being violent/ 2nd, 3rd, 4tf offense type of stuff.... -They can be offered "Self Deport" and given a time to leave the country by. I know it sucks, I know. I have had to release the illegals I have encountered knowing that they are never going to show to their IJ hearing. If they do that, kids or not, and they skip out, it is an automatic removal order. If we encounter them again, they are locked up, jailed then removed. Things here on the northern border are not nearly as busy as they are on the southern border and we still get "...can not detain...release." Frustrating to no end. I am not sure 100% about the BP policy on the southern border if they are allowed just to put them on the deport van and wait for a ride home, or if they are allowed to get infront of a judge....Maybe one of our resident BPA's can answer that. I will send an IM. |
