Friend of mine has his own shop and does NYS inspections.

A few months back most of the small shops have this "under cover" inspector asking to do illegal inspections, wants an appointment. The law says that you must give a written appointment within something like 7 days or so.

My friend tells the inspector "I don't do quick inspections, my hoist is tied up, if you come back tomorrow I can do a proper inspection".  He does not give the inspector a hand written appointment. My friend never hears from the crook.

This inspector hits most of the locale shops with the same line. Another shop down the road from my friend tells the "under cover" inspector that he can do an inspection later in the week to leave his number and he will call him. Now my friend and this other shop owner talk and realize this crook is trying to set them up. The other shop owner calls the inspector and make an appointment (not hand written) the crook never shows for the appointment.

Today most of the shops are hit with fines, they are told that the fine will be $200.00 if uncontested, other wise if the chose to fight it, they will lose their license until the outcome of the trial and the fine will be anywhere from $750.00 to $1000.00.

Both my buddy and the other shop owner down the road settle for the $200.00.

But hey, We'll give low income families $200 a kid, no questions asked, for "school supplies".  I'm sure it's just a coincidence that Walmart just happened to sell out of flat screen HD TVs the same week.

I understood it.
Sounds like your friend needs to follow the letter of the law.
Sometimes the unintended consequences of overburdening regulation can lead to hilarity.
Make the inspector wait while he types on up.
"Damn, I'm out of paper. Wait here untill I get back from Office Max."

Probably because your state doesn't have annual safety inspections on vehicles.  As I understand the OP (my changes in red):

My cousin who owned a pool hall in Staten Island told me the same shit. He got fined for operating a restaurant without a permit and had to go to classes for food prep. All they ever served was Beer, Wine, water, and packaged candy, chips etc.
He was really fucking pissed off. He recently sold it. He got in an altercation with one of the inspectors. Another commented: What the hell am I doing here, this isn't a restaurant!. He was fined 1500 dollars and had to pay it upfront prior to a hearing.

Empire Zones!


I think NYs entire tax strategy upstate is to fool businesses into moving their PP&E into the state under temporary lax tax restrictions (Empire Zones) to offset the massive payroll and unemployment costs that NY levies,then,when the company is locked in place by their investment in property, plant and equipment that can't be easily moved somewhere else,they jack the taxes up, strangle the golden goose,and then start the cycle over again with a new business.
This seems to be their taxation model. The only businesses that seem to survive upstate are small cash based businesses that hire guys under the table,hide their earnings with personally held "business expenses" and skirt the regulations. You can't get money from the people. Most of them either work for one of the gazillions of local goverment agencies, or they work part year service jobs for the minimum required time to collect unemployment for the rest of the year.

With most states/counties around the country having huge budget shortfalls, be prepared for jurisdictions to pull out their bag of tricks to get as much $$ as they can. Thought I read somehwere last week about one Police Department out west being told to literally pull people over for doing up to 1-2 miles over the speed limit, and for things that may have been overlooked by overworked Departments, like vehicles pulling over the line when coming to a stop at intersections, for jaywalkers, etc. Be prepared for county/state inspectors to be blanketing commerical properties and small businesses in an effort to cite code violations. It's going to get bad, and thanks to Obama, it's really only going to get worse.

Does New York currently have health inspectors who check on the sanitation in restaurants?

Some years ago NYC didn't, or so I heard. When asked why they wouldn't have inspectors the reply (serious) was, "If we had them they'd just take bribes."
