Here is the story... When I got back from Afghanistan in 08 I paid a guy who runs an FBO in Alabama for instrument flight training. Total was close to $4,000. I went down there in Late Jan and flew once. Weather was sketchy. I flew about 10 hours on his old simulator as well. After about a week. I got kind of sick and I had some stuff to take care of up in Iowa. We agree I would come back at a later time and finish up the training. That spring my dad had a stroke and I ended up in Florida with him for a month or so kind of helping  him out. Then I had a month long AT in PA. Right after the Annual Training, I had to Move up to Alaska as I had transferred to the AK guard. AS I was driving up I called him and asked about a 1/2 refund which I thought was pretty reasonable as I had not flown hardly any. He said the contract I signed (which I did not get a copy of) said no refunds. I told him I would be in touch then to set up a time for me to come down and finish.

Since then, he will not answer my calls or e mails. Anyone have any advice on what I can do?

legally you are probably SOL.

He is probably broke too so give up on the refund and try to get your time in. You may have to knock on his door

this right here.  Most of the time you just have to get back and finish.
your money was spent and not escrowed

you'd probably get more response in the legal section.  that being said, if the contract states no refunds, then he likely won't have to give the money back, unless he fails to hold up his side of the contract, in which case he'd be in breach and owes you a refund, at least partially.  b/c he is not returning your calls, i'd guess he's either out of business or really close.  you also could claim that he's in breach since you are now attempting to schedule and he is preventing you from doing so.  you can check w/ the secretary of state in FL and see if he's still in business.  also, i'd call an attorney in FL and pay them to write a demand letter on your behalf.  it's a gamble, but might be worth the money.

btw, i'm not an attorney licensed in FL, so the above is not legal advice, i'm just summing up what you could've found on teh web - i'm nice like that.

I appreciate it. I had no idea we even had a legal section 0here. ARFCOM is the best!
