So a guy I work with is a Mexican citizen and has a green card, he's been here since he was 5 (45 years ago) and took his step fathers last name. Now he's been here, with his step fathers name for 45 years. Has a D/L, green card and the works in that name. He is on track to be a US citizen this summer.

Now we need him to go down to Mexico to do a job, however he went to the Mexican Consulate yesterday and they would not give him a mex passport because his mex birth cert (that he had to have mailed from mex last week) has his old name on it that he hasent used in 45 years. This is the only document that he has ever had with this old name on it, thus the Mex consulate wont issue a passport without another form of ID with that name.

Is there any way he can get over there and back just with a green card? If we cant get him over there, I might have to take his spot, so im busting my ass trying to help this guy. Mexico sucks.

I think he should be able to get a Re Entry Permit as a permanent resident without having to obtain a Mexican passport.

Have him sneak across the border?

Millions are coming north that way, shouldn't be too hard going south...

I'm guessing a little bit of baksheesh/La Mordida in the right places will help him out. It is how they operate down there, for the most part.

So that gets him back in the US, but does it get him into Mexico?

Pretty sure he needs a passport to fly. He can cross at a land border w/ his green card. He should have a company letter explaining his itinerary also.

This situation, and his status in the states, wouldn't call for a travel doc or re-entry permits. If someone no longer has a country to go to, or is a refugee, or has an asylum hearing..not is gaspain's co-workers case.

He doesn't need squat as far as "re-entry" permits go for getting back into the US. Once his permanant LPR status was granted, all of that is no longer needed..unless he was leaving for more than 1 year or he wanted to move into a commuter status where none of that is presented here.

He would be good to go coming back into the states with just his green card. He will not need one (passport) getting back, even with air travel.

His issue is going to be with the air carrier and mexico...for those I can't speak for.

ETA:

Mexico sucks.

I agree.

If he just showed up at the border and tried to cross into Mexico, would INS really try to stop him if he said he was going home?

Lets see...

Has a story why he can't cross the border.
Been a permanent resident for 45 years but is just now "on track to be a US citizen".

Doesn't look good. Is driving an option? He's still a citizen of Mexico so I wouldn't think they'd keep him out and his green card will get him back in.

If I recall, the "best" ID you get in Mexico is the card you get after completing your compulsory military service.  They use it as a way to try to make sure that lots of people do their time in the military.

I also heard while I was down there that if you didn't have that card, it was next to impossible to get the paperwork from the Mexican side that you need to come up here.  That may be part of why the Mexicans are dragging their feet.
