| Are there any restrictions as to the types of firearms you can carry concealed in FL if you have a permit? Could you, for example, carry a shotgun or SBR if it were hidden. Mind you I have no plans to do this, this is purely a hypothetical question that came up with some friends over some beers so I figured I'd ask those who know more than me. |

Keep in mind I have no idea of the legality of it, but you'd have to consider the practicality. Concealed means concealed Even Crossbreed couldn't make a holster to conceal an SBR/12ga ...then you're talking a backpack or something... anyway, I don't think there are specific regulations on the types of firearms you carry, because a CWP pertains to multiple types of weapons (guns, knives, tasers, etc) My assumption would be that , under the condition that the firearm is legal to own: If you can conceal it, you can carry it. Again, bear in mind my first sentence.

| The law is unclear as to if you would be allowed to carry a SBR or SBS because the concealed weapons permit statute ยง790.06 states "For the purposes of this section, concealed weapons or concealed firearms are defined as a handgun, electronic weapon or device, tear gas gun, knife, or billie, but the term does not include a machine gun as defined in s. 790.001(9)." Clearly the list does not specifically exclude the carry of such weapons, but the maxim "Expressio Unius Est Exclusio Alterius" would make me nerous about being the first one to try. |

Pursuant to Florida Statute 790.6(1), the license "technically" covers only handguns, electric weapons, tear gas guns, knives and billies, however, as a practical matter it covers any weapon or firearm other than a machine gun or destructive device inasmuch as Florida Statute 790.01(3) exempts persons with a valid CWL from any of the prohibitions of carrying concealed weapons/firearms. Of course there are no cases interpreting this facet of Florida Statute 790.01, and therefore if you want to be completely safe, stick to the weapons listed. |
