While I was at work today someone came to my door, my wife sees some stranger outside and there is no vehicle in the driveway so she chains the door then opens it about 1 inch and says "What do you need?" the guy replies "I'm an officer with the courts" so she closes the door and goes back to gardening in the backyard. Later on in the day she had to go to school so she goes out front to get to her car and there is some papers sitting on the ground on my front porch. Am I served? I just came home and she told me this story, she swears there is no more to it then that, as soon as he said courts she slammed the door, and the only thing she said to him was "what do you want?".

Sounds like someone could have easily swiped those papers off your porch and you could have never received them...

Also, how does the server know they even had the right house. Sounds pretty flimsy. I, personally, would just shred them. The guy can't prove he served you or even the right person at the right address. The server may argue otherwise, but make them do their job properly.

I know what you mean man, and it is raining really hard right now, if my wife had gone out the garage door instead of the front door then those papers would be getting ruined and destroyed right now.



But my question is if I miss a court date isn't there then a warrant out for my arrest.

A fucking red light camera, I had the choice of slamming on my breaks and getting rear ended or running the yellow, I ran the yellow and it turned red and flashed me. I guess in retrospect had I slammed on my breaks I would have got rear ended and made money in pain and suffering pay out from the insurance companies instead of now losing money from paying for a bullshit ticket.

You got served.  The service laws are pretty liberal.  

Service upon an individual from whom a waiver has not been obtained and filed, other than those specified in paragraphs (e), (f) and (g) of this Rule 4.1, shall be effected by delivering a copy of the summons and of the pleading to that individual personally or by leaving copies thereof at that individual’s dwelling house or usual place of abode with some person of suitable age and discretion then residing therein or by delivering a copy of the summons and of the pleading to an agent authorized by appointment or by law to receive service of process.


Essentially, if the server knows someone of "suitable" age is home, they can leave it on the door - even if you refuse to answer the door.  Unfortunately, you should have trained your wife better.    When you think you're going to get served, you can't even have your windows open or make noise to indicate anyone is home.

Just went through this myself, all they have to do is make contact with someone of "responsible age" they don't even have to talk to you, or your wife for that matter, just "make contact," which happened when your wife opened the door.

I'd look into driving school.  It'll save you on your insurance rates in the future.  Also, a lot of cities let you do it online, so you never have to leave the house.

I think you have to go in and take a test. The have certain things pop up, and you have to verify what they were to prove you didn't just walk away from your PC.

My dad took the on-line course at http://www.ddcaz.org/

It wasn't cheap but was $60 less than the ticket and no points.

He said the course took about 4-1/2 hours to complete.

Do the class online. If you have a notary friend have them come over when you take the test and sign it. Otherwise login in for your final test at a UPS store and they'll notarize and let you use their computer for ten bucks. I did drivinguniversity.com. The cheapest rates I could find for what they charge, plus they fedex a copy of your diploma to the courts to show you finished. GTG.

In Colorado two guys came to my door I didn't recocgnize, did not answer door. They left service papers on doorstep.  Next thing you know I was summonsed to court. The same person who notorized papers drew them up so I figured it was all bogus.  Couple months later wages were garnished. It's you're word against theirs..

This.  And guess who the judge believes?  I know you're already dealing with your ticket, but just to relate a story for reference to anybody else that gets "served" similarly...  I've been "served" by a process server stuffing papers in my mailbox without ever coming to my door before.  Judge didn't give a shit about them stuffing papers in my mailbox nor that they made zero attempt at contact.  If I had ignored it, I would have had a summary judgment against me.

Traffic school you mean. Defensive drive is court sentenced and run anther $200+ on top of the ticket  

I hate red lights. I bet you were in a 35mph zone, those yellows are always a little to short.

Youre served. Might as well fess up. If you want to try to fight it, you might be able to. But Im sure its not worth it.
