Well, I am having problems with the new neighbor behind me. Off the bat, I believe he's white trash. He has his kids playing in the backyard in dirty underwear or nothing at all! Secondly, he has these 2 really beautiful FOX HOUNDS that are kept in one of those fence type dog kennels w/ a tarp for a roof all day and all night long. Since there are cats running rampant -3 neutralized- all over the neighborhood, these dogs bark all damn night long keeping me awake. How would you approach the neighbor and when -and what- could you do with respect to a legal standpoint? |

I lived in Dallas for 20 years, and animal control visited our neighbors a few times for their dog howling all night. I believe they were warned the first time and ticketed the next couple till they started putting their dog in the garage @ night. Give them a call. As far as the cats............ NFA items would do it. |
| I would usually offer that you talk directly to them. However, since it sounds like this is an ongoing thing I would say this time just call the authorities and get the situation documented from the start. One or two nights of noise during move in is one thing. All night every night is something the owners should be taking care of without intervention. Since they haven't I'd say they don't really care about others so why waste time trying to be friendly about it? They aren't. |

Any broken glass in the backyard where the children are playing? Child Protective Services might be interested.

I would suggest that you ask the neighbor nicely without any authorities. I know if it were my dogs, then I'd take it to go out and "shush" them when they started up. You might have to put up with it for a week or two until they learn, but if he's actively trying to control the situation, then I'd give him the benefit of the doubt. However, the "white trash" crowd may not do that. So, step two would be after asking the guy again, to make a complaint to the city as it is against city ordinance. From then on, it's out of your hands. But, once the authorities get involved, then it can start leading to a hostile relationship with the neighbor. (which the "white trash" crowd can do). |

NoAim, you seem to have white trash and dirty white trashers mixed up. Are there any rigs upside down in the yard? Tarps on the roof with tires and pallets holding them down? Perhaps a truck canopy for a dog house or fort for the kids? How many burn barrels in the back yard? Christmas lights still up? Rotten pumpkins on the porch? If the answer is NO to the above, it's just white trash. |
| My ex-neighbor tried to report me for my dogs. He was pissed off that the dogs would bark while he would use our joint fence as a backstop for his soccer ball, or rattling around his wood pile at 11pm in the dark. My dogs were normally in the house, and when outside they would bark if someone approched the fence and didn't acknowledge they were there. I don't know what his problem was, the other neighbor got it, the dogs would bark, he'd call to them and they would quiet down. Funny thing was he finally asked me what I was going to do about my 'dogs' spoiling his 'quality of life'. I told him that I would do absolutely nothing, he put his house up for sale the next day. He ended up moving about 4 blocks away, next to people that we knew. They have 2 dogs and they're outside all the time, bark, and are far less obedient. Fool. |

Go to the store and buy one of those bark stoppers. You place them as close to the dogs as you can, but in your yard. Then, when the dogs bark, they give off a high piercing sound that only dogs can hear. Eventually, the dogs will learn that when they bark, they get pain, and they will quit barking. |

All joking aside... don't shoot at his dogs with a pellet gun. 1) It won't do anything to shut them up 2) If your luck is like mine, he's probably got a web cam aimed at your house and you'll end up in jail and on "America's Dumbest Criminals". You talk to him, if he acts like an ass about it... starting dialing. Makes the decision easy if the guy is a jerk. My only other suggestion would be to find out if your county has a noise ordinance and then call only when it is after that violation period. e.g. after 10 PM. So you can get him cited for that specific violation. |

ORS 609.095 Dog as public nuisance; public nuisance prohibited; complaint. (1) A dog is a public nuisance if it: (a) Chases persons or vehicles on premises other than premises from which the keeper of the dog may lawfully exclude others; (b) Damages or destroys property of persons other than the keeper of the dog; (c) Scatters garbage on premises other than premises from which the keeper of the dog may lawfully exclude others; (d) Trespasses on private property of persons other than the keeper of the dog; (e) Disturbs any person by frequent or prolonged noises; (f) Is a female in heat and running at large; or (g) Is a potentially dangerous dog, but is not a dangerous dog as defined in ORS 609.098. (2) The keeper of a dog in a county, precinct or city that is subject to ORS 609.030 and 609.035 to 609.110 maintains a public nuisance if the dog commits an act described under subsection (1) of this section. Maintaining a dog that is a public nuisance is a violation. (3) A keeper of a dog maintains a public nuisance if the keeper fails to comply with reasonable restrictions imposed under ORS 609.990 or if a keeper fails to provide acceptable proof of compliance to the court on or before the 10th day after issuance of the order imposing the restrictions. If the court finds the proof submitted by the keeper unacceptable, the court shall send notice of that finding to the keeper no later than five days after the proof is received. (4) Any person who has cause to believe a keeper is maintaining a dog that is a public nuisance may complain, either orally or in writing, to the county, precinct or city. The receipt of any complaint is sufficient cause for the county, precinct or city to investigate the matter and determine whether the keeper of the dog is in violation of subsection (2) or (3) of this section. |

Hey Ken, when did you start sleeping at night...LOL I thought you worked at night. I would talk tot hem first, then got to a hgiher power. When I called in about a dog they asked me if I talked with the neighbor first. I did it, then a called in a week later. Dog problem solved. But neighbor hated my guts until I moved. Darin |
Kill the messenger?? It ain't the dogs fault they are left outside and probably not getting the attention they need. Shoot the owner and they will get the message... I would pass on taking it out on the dogs also... I had the same issue with two neighbors at the same time. Dogs left unattended all day and or night barking and raising hell at anything and everything. Talked with both of them about the noise issues and even offered to let the one neighbor bring his dog over to play with ours during the day when ours were out. One problem solved and the other took several phone calls to animal control to get solved. It took some time and video of the dogs finally did them in as animal control can't always show up at o'dark 30... Good luck... |
