ok, i know that you can get a dui on a lawnmower, golf cart, segway ect...

can a disabled person get a dui for operating his powered wheelchair over the limit?

technically the chair is their "legs" so i could totally understand a public intox or drunk and disorderly but im asking specifally about a DUI.

Last I checked we are no longer allowed to pick on the handicapped, only the fat people are still fair game....Oh, and the people who wear socks with their sandals: I know this because I wear socks with my sandals

I think in most areas it would only be a PI, as it would cause an absolute shitstorm if you gave them a DUI because of the chair/scooter. But I have seen a few of the scooter-wheelchairs that can really get up and go, but I still think they would be protected by one or more rights groups if you tried it.

i understand if it was a normal disabled person that could use a normal chair but is lazy so to speak.
what if they were not able to use a normal chair due to other disabilities say only one arm or some shit.

his only way in the world to move is a powered chair but they are also over 21 and got stopped while swerving down the sidewalk on the way home from the bar

In WI it doesn't even have to be motorized...you can get nailed on a bicycle.

They will also hit you for public intoxication just walking home from the bar.

The moral of the story is drink at home, lock the doors, draw the shades and keep the music down.  Do not answer the door.

If you have guests over and they drink, make them sleep over.

With these conditions...I would follow them and make sure they got home safely...and call it good. The only time I used PI was when someone was being a jerk, or they were going to get hurt. State laws vary greatly, but some states call it a PI when you are in your own yard, if it does not have a privacy fence, and if in plain view of the public....to me it was their time, and their right. Little petty stuff only causes more people to despise the police.

Public intoxication is public intoxication, whether the dude is walking, standing on a skateboard, or riding on a fucking magic carpet.

At least that's what I have been told.........

Doesn't need a motor, just needs to be a mode of transportation that requires operator control. That's why the charge has, in most cases, been changed from OMVI to OWI. I've heard of people getting OWI for riding a bike while drunk. One case on Cops involved a domestic call. Drunk guy on the street riding a bike and his wife/girlfriend/ex didn't want him there or something. They arrested him for being drunk on a bike.(the pedal kind)

Someone who gets it.  It wasn't about hemming the guy up, it was about trying to keep everyone safe.  Where the hell did that mentality go?  I'd be much less wary of cops if this was the case more often. However, in my experience, at least here in CO, it really is about money.  It is obvious.

This is also true for Iowa.   Knew plenty of college students who got DUI, riding a bicycle.  Not sure if it was a serious of a charge as a car....   Don't remember if they got their licence suspended.
