AFAIK NJ passed a ban that has the same restrictions as the federal ban but does not sunset. So once the federal ban expires NJers are still screwed. Interesting aside, I wonder what type of provisions NJ, NY etc have in place for repealing their state level bans...

The state banswere passed specifically to cover the sunset of federal law. NY changed the wording of the law to "Posessed" instead of manufactured so that in 50 years there will be no more legal AW's in NY. Since you cannot have "posessed it" if you were not alive at the time it was made. Also it rases the question of "who posessed it" prior to 9/14/94 and is such possestion legal? Also since the law was passed only two years ago when it was realized that the federal law was sunsetting is there "grandfathering"?

Its a whole new legal ballgame because its so poorly thought out. Its a shame you don't know what it means until its been fully litigated.

In NJ some of the laws are based on the federal laws - are they not?
So, will they change when the sunset happens?

The State will have to change them.

The language of the NY AWB is the same as the federal ban except that it does not sunset. Possession as it relates to the AWB means that on 09-13-1994 the SAW was lawfully possessed by someone. Someone could have been a person, dealer, manufacturer etc. Furthermore it specifically allows the lawful transfer of a SAW after 09-13-1994.

State laws will remain. All of you gun owners in anti-gun states will not benefit from the AWB sunsetting. I feel very bad for all of you. You live in mini-police states.
