First I'm glad there's no serious injury to her.
Second, the second car stopped with no lights? So, did it stop and then its driver lifted his/her foot from the brake or did it stop without lights, raising the issue that it had no tail lights? Second, if the person just stopped to invite a collision, it could well be the other driver's fault. My brother had this happen on a state hwy. Woman driver ahead of him suddenly stops her car to converse with the driver of the oncoming vehicle. At least she had to pay for that one and not my brother. |

Plaintiff counsel will get 40 percent, making up to 80 as profit, boheave FSA will get the remainder, buy her children ATVs (but no helmets), buy a new Chevy Cavalier ( or what ever piece of shit econo / swank to the unwashed masses entry level vehicle GM makes theses days), throw a big shindigg for her friends and relatives in celebration, where at, one of her spawn will wreck their ATV into a gas meter suffering second degree burns on over ten percent of their body, whereby, they will sue the ATV manufacturer, the gas company and the trailer park owner for not stopping them from riding the ATV on his property

Because the other car was stopped in the lane to make what b sounds like an otherwise legal turn, even if the blinker wasn't on that doesn't matter in this case. Lack of the blinker wasn't what caused the accident. Bottom line, this other person got rear ended and only in very rare circumstances is the person who did the rear ending no at fault. To add insult to injury, and I'm not trying to be a jerk, and I'm glad all are OK, but careless driving is a better fit it sounds like than following in that instance, so she prolly got a little help from the officer. ETA. To explain a bit more, following too closely really just applies when both cars are still moving forward and the car in front stops short for whatever reason and the car behind can't stop in time In this instance it sounds like the car in front was completely stopped and the OP'S wife noticed it and then jamed the brakes. Kinda splitting a hair bit we would usually write following even though careless would be a better fit. This would depend on the driver too if they were decent or not. Ultimately, the charge Didn't matter as long as there was someone ticketed at fault and following wasn't as serious as careless so non reason to jam them up more than what was required. Again glad all ok.. Just trying to explain and.answer your question. |

I'm sure every state is different, but in Michigan if you rear end someone you are at fault. Doesn't matter if they are turning or had their turn signal on/off. Even if someone slams on their brakes you are responsible for maintaining a safe distance between you and the car in front of you. The only exception is if the car in front doesn't have lights and it's at night.
That being said accidents happen. No one's perfect. |

Exact same thing happened to me in my five month old car. Airbags deployed.
Road was wet, I didn't see brake lights. The thing that saved me financially was the other driver had no insurance, and had questionable citizenship. I paid the ticket for following too closely and my deductable. My car got fixed, and that was the last I heard of it. I never heard a peep from the other driver. |
