Received this letter from my chief of police after passing the NCIC check. Dear Mr. ------ I am returning your federal firearms form to you. It is my policy not to sign any federal forms to certify or attest that I have no information that the applicant will use the weapon (or device) for other than lawful purposes. Sincerely, ------------ Chief of Police HE even sent me the copy of the NCIC report. Lived in this city all my life 51 years. |

You can not force them to sign. There are plenty of others who can sign. Sheriff, County Attorney, County Judges, Head of your State Patrol, Check with a local C3 dealer in your state and see who they have gotten signatures from before. If all else fails you could set up a corporation for the purpose of investing in NFA firearms. This would be a difficult and last ditch proposition. Corporations do not have fingerprints and do not ask for CLEO certification. |

Where in VA was this? I he kind of helped you out in a way. He sent you a copy of your NICS check so you could show it to the next person that you try to get to sign the form. Yes it would of been easier if had just signed the paper but he could of made it harder as well. |

Hey LarryB2-- I'm just curious about something. Why did the CLEO take your paperwork, if it is against his standing policy to sign? He obviously knew what questions were on the Form 1, so why did he go to the trouble of running the background check and taking all your stuff, just to turn you down? The reason I asking is that I will be applying for a SBR. When I called the police station, the secretary said that interviews with the CLEO are unnecessary and I should just leave the forms with her. I just wonder if this was the procedure that you went through. |

Larry, You should explore the Commonwealth's Attorney's Office as an option. You can also make an appointment with the duty judge at either the Circiut Court or General District Court Judge and ask them to sign. Bring your paperwork, INCLUDING YOUR BACKGROUND CHECK FROM THE STATE POLICE (they have a standard form you fill out and pay a fee at the Portsmouth PD's Office). Tell the judge or commonwealth attorney you just need there signature on the form and show them the provision explaining who can sign (at the bottom of the second page). |
