My 2011 Durango was rear ended while stopped at a red light. The other driver was cited for following too close and careless driving. I received no citations. Both of us have Progressive Insurance (spare me the Progressive CEO is a libtard bullshit, I dont care. All insurance companies are crooks and will support whomever will legislate fovorably for them). This makes me nervous since my insurance company is going to look to minimize the claim since they are paying even though I wasnt at fault. I filed a claim and the other party notified Progressive as well. The fault is not being disputed by either party. He admitted fault. No one was injured but my SUV has significant rear end damage including: rear hatch, bumper cover, hitch, back up sensors and camera, plus all the shit that I cant see. Progressive is PUSHING me hard to settle and take my DODGE to their claim center for repairs. Their repair center is a GMC / Buick dealer. I havent agreed to anything but would like some suggestions on how to get my SUV fixed right. My first inclination would be to take it to a Dodge dealer. I dont know if aftermarket parts are available for a 2011 yet. I know I have the right to take it anywhere I choose but beyond that I am ignorant to how to deal with insurance companies. I say again, no one is hurt, I am not looking to sue anyone based on a bogus claim, I just want my new truck (<5000 miles) fixed right and done so in a manner that when I trade it in in a couple years I dont get hosed on trade it because of the accident. Suggestions? |

I had Progressive for a few years, and ended up in a similar situation as you. I was hit by a guy insured by Progressive.
They did everything they could think of to fuck me. The wreck was undeniably the other guys fault, that was never in dispute. I was stopped waiting on traffic to clear, he wasn't looking and managed to not notice the White Chrysler LHS in front of him and put the spurs to it just before he hit me. My car was trashed, and the progressive claims adjuster was a huge dick. He gave me a serious run around about getting me a rental car, at first he wanted to get me a subcompact as a replacement for a family sedan, then he refused to have the car delivered to me or even arrange for me to pick it up at the airport rental agency a few miles away from my house, I had to get a ride to the next county over to get it. Oh yeah, my uncles funeral was the day after I got hit, and I needed a car ASAP. Once the estimates were in, and they deemed my LHS to be beyond repair, he starts on the low balling shit. He offered half of what the book value was for private party sale, and when I told him to pound sand, he showed me examples of "similar" cars for sale in Atlanta, which is 120 miles away. I looked at the examples he found, and they all had 200K+ miles, mine had well under 100K. After finally agreeing on a value for the car, he went at it again, he tried to reduce his offer because "I went out and looked at your car and found a few things". He wanted to knock $300 off because the car was dirty, and needed vacuumed. We got hit on a Sunday in February, it had been raining for days, sure the car was dirty, but nothing that five bucks at the do it yourself place wouldn't fix, he claimed that a professional detail guy would charge at least $300. He wanted to take $400 off because both of the chrome tail pipe pieces were missing, I suggested he look in the grill of the car that rear ended me, they were on the tail pipes until the wreck. Eventually he caved and gave me exactly what I wanted, but only after I said the magic words "My neck and shoulder have been stiff ever since the wreck, my wife was so upset she was puking, and all three of my kids aged 3 to 9 have stiff necks and bruises from the straps on their safety seats". For some strange reason the jackass adjuster disappeared as soon as I made that statement, and came back with two checks, one for the exact amount I wanted for the car, and another for an additional $2500 for "minor injuries as well as pain and suffering". I had no intention of making an injury claim, all I wanted was a fair price for my car, but it turns out that just mentioning toddlers with injuries gives insurance adjusters the heebee jeebees. |

It's a corporation. It doesn't care about morals, ethics, or human decency, there's fucking money at stake here. Don't you read GD? They're doing exactly what they should do to fuck everyone except their stockholders as hard as possible.

| This is why I pay a bit more money to not deal with this shit. The last car claim I had I was asked where I took it to and they would take care of the rest. A week later I showed back up and paid $500 to the body shop and I had my car back. Any other claims I had I went to my agent and was cut a check on the spot. I have State Farm. As a family we have had them for about 100 years. |

I would use the one that has the reputation for the best work. |

I have Allstate. Had a streak of three accidents with my Suburban (two while I was driving, not my fault, one while wife was driving, her fault). Took it to the Allstate claims center, they wrote an estimate, I confirmed with my bodyshop (using original, not aftermarket parts) and picked up a check within 48 hours. Both of my accidents Allstate waived my deductible, no questions asked. I give Allstate 10/10 on all three claims. |

Also carfax is a joke in a lot of states including Ohio where wrecks and accidents are more often than not MIA from carfax reports. |

The adjuster made that decision after speaking with me and gave me a check for the full amount of the repair. |

This I know, but its counterintuitive to take one manf car to another to be repaired. I understand indy shops but the big three seems a bit strange. What I am really concerned with is that since Progressive is paying for this repair no matter what, then using their repair center they will try to skimp on replacement part and try to reuse fasteners and things that really should be replaced. At least at a third party shop I may get an honest assessment of the damage and what need to be replaced. |

I guess as the above poster stated, maybe not all states allow it. Honestly though, would you pay asking price for a vehicle you knew was in a collision? I think he deserves to be made whole.

Take it to someone you know. Or ask a mechanic you know who he knows that does body work.
I had aim incident where I was hit by another state farm insured driver who hit another four cars after me. They gave me the fuck around for a long time. Trying to give me junk yard parts for my factory warrantied BMW, not giving me a rental...all kinds of shit. If it were not for independent shop, recommend by my good friend who is a BMW tech , I would have been ass fucked. State farm was trying to get away with 1900 in "repairs". By the time everything under my front end was fixed correctly it was over 10k. I could tell from my first call to them the fix was in. My only regret was not getting a slimy lawyer ASAP to fight for me and my 1yo daughter. I was too honest and since we were relatively fine I thought they would be honest and just fix my car back to factory. Nope. Never again. |
| A dealer body shop is different than a dealer service center. I had a small fender bender and also questioned the wisdom of bringing it to a dealer of a different brand. Turns out that the body shop is just that... a body shop. Makes no difference. They all draw parts from the same parts distribution center. The work they did was excellent and you can't even tell there was a dinger. |
| If your vehicle has less than 12,000 miles in most states you HAVE they have to buy new OEM parts. After 12K miles - you can get non oem or remanufactured parts. Dealers are the worse places to get your vehicle repaired. It always makes me laugh when the FIRST inclination people have it to take their priceless little cars right back to the place that ripped them off on the purchase of their car. I swear its too funny. |

one of my volvo 240s was nailed by some dumb bird... totaled it good... insurance was progressive...
when i spoke to the agent concerning my payoff, he asked if i was aware that the car was rebuilt from a totaled automobile (i forget the phrase that is used for this) and said it cut my payoff in half... instead of rolling over like I am sure they thought i would do, i asked if something like that would show on the title... you bet it would... the look on this jackhats face when i came in with a clean title was priceless... he was so sure of his bullshit they had already made out the check for the lowered amount... anyone that suggests that ANY insurance company is better or different than another is so full of shit it is sad... |

Quoted: This can be done, though the insurance company will fight you tooth and nail. It's called a diminished value claim. My sister is a perfect example. Bought a brand new Jetta, got T-boned six months later by a texting teen. Don't know what she paid, but let's say the car, at the time of the accident, was worth $20K. Major accident, airbags deployed, car was repaired not replaced. Value of this car, having been in a major wreck is now $15K. My sister is entitled to the $5K difference from the insurance company as a diminished value claim.Quoted: Quoted: Clark Howard was talking last night about an accident. When my 96 Impala was hit (less than 17K on it in 2005), I took that fucker to the Maserati and Ferrari certified repair shop in South FL. Adjuster asked me who I was taking it to and I said "First Class in Pompano." He goes "Oh boy, I better make some changes" and kicked the estimate up quite a few dollars.
I couldn't even tell the car was hit and when they were done. Take it where you feel they'll do the best job. |
