Can a next door neighbor cut off branches and limbs of my trees that overhang onto his property?
The trees were there before old man moved in years ago.

FYI, if the tree poses a danger to his property, and he notifies you about the danger and you refuse to take it down, you can be responsible for his damages if the tree damages his property. That is, assuming the trunk is on your land, he can shear anything on his side of the line.

You bet they can. I have to remove tree limbs rubbing on my shed from across a fence. I also have to cut back bushes and trees so I can mow against my fence line. My back fence neighbor likes my peach tree overhanging his fence line, and enjoys many peaches each year. |

That's what I thought.
I guess I really don't care as long as he doesn't damage them. They're Clump River Birches so the produce a lot of trash anyway-less for me to clean up later I guess. But would have been nice to know he was going to do it instead of looking out and seeing him on a ladder whacking away with his recep saw. Usually when little trigs fall on his yard he tosses them over on mine... |

But it was so bad that her bushes started to actually grow over into my yard and every time I trimmed them back she'd bitch that I was destroying her plants. I wanted to giver her an opportunity to fix it. Just didn't want it to seem like I was trying to damage her stuff. She was 83 and paranoid that everyone was out to get her. I didn't want the hassle of dealing with her and wanted her son to do it. But it never happened and I ended up doing it which caused a huge argument with her that I was trying to avoid. She accused me of moving property lines even though they are clearly staked and have been for years. The woman was nuts. |
| My trees only became an issue for him after he planted a bunch of stuff next to/under them a couple of years ago. Ever since then he's keeps asking me if I would cut them down. I'm always like."Uh, no. Why would I cut down trees I planted?" I'm not upset or anything, all of my neighbors are really very nice and easy going people. |

| A friend of Dad owns some land that joins TVA. There are dead trees leaning and one fell on a house during a storm. He hadn't really had any lots surveyed out when he bought them in town. He got his ass in gear and got it done. Turns out it was on the homeowners land and he dodged the bullet where the guy was gonna sue him for the tree falling. |

| Damn right. My last neighbor had a huge apple tree hanging 8 feet over my fence dropping shit all over my driveway. She gave me a skanky look while I was up on the ladder trimming it all back to the fence line. Looked ridiculous when I got done. Didn't even give a fuck. |
