Hi, a good friend is having a property dispute that has been getting ugly and just got real bad. The neighbor is now attempting to run over her and her daughters and the county won't do anything, claiming there is no proof the neighbor did anything. They need a restraining order against him until her husband gets home (long haul trucker) and the county won't issue the restraining order without knowing his DOB. (not that we are dumb enough to think a restraining order will stop the neighbor, but it will provide additional defense in case she has to exert deadly force to protect herself or her children from him)

We all think this is pure B.S. since the house he lives in next door is in his name, there have been many previous complaints, all of which the Sheriff's dept. refuses to take any action for, but they can't issue a restraining order without his D.O.B. which they have but can't give us?

Is there a way to get his D.O.B.?  Is there a way to force the county to issue the restraining order without the D.O.B?

If your friend really needs a restraining order, it won't do much good other than make a paper trail.

If your friend doesn't really need a restraining order, the other person will stop bothering them.

eta Or they could set up cameras, get witnesses, etc.

I still think that something is missing from this equation.

Yeah try to get evidence yourself and put your own case together. But yeah restraining orders don't do anything besides help build a case. The polce will wait till he actually does something like if he kills you then you have a case Self defense is the only way to stay safe. Nobody can protect you as well as yourself.

As others said the RO wont keep her safe.  Maybe she can go stay with a relative or friend until this is sorted out.   If not, make sure she's armed and know how and when to use it.  Put up cams.

Have your friend speak to an attorney.  Very much common sense.  Or spend the money on a private detective.
