My wife signed up for a one year membership at a local health club. It's coming up on 1 year and we want to cancel, so she called to find out the anniversary date. They said she initialed for a 2 year membership. She tells me they asked her about a 2 year and she turned it down, then they asked her to initial some items. Looks to me like they snuck this in on her. Are we stuck? |
No, there is still time to Divorce the Wife before she signs you into the Poorhouse! Seriously, you NEVER sign anything without reading every page AND getting a copy. Many States still have it on the books, though rarely enforced, that a Contract is NULL and VOID if a copy is not provided to both (all) parties that are signatory to it. I totally annoyed my own Closing Attorney when I bought my house because I read Every Line on Every Page of the whole deal. It took over 2 hours, but I will have NO surprises for the life of the loan. (I also have a Fixed rate, so...) As to the Gym Membership, you might try playing chicken with them. Deny that she signed for the 2 year deal, and threaten to sick your 'Family Lawyer' on them. They might just fold, knowing that their practices are shady and would be subject to scrutiny. The wifes on my shitlist for the day for not paying attention. :) And yes, when I signed my mortgage I made them all wait while I read the fine print. |

I just joined a gym about a month ago, and before I make any commitments, I try to do as much research as possible. I found out that health clubs and gyms are very unscrupulous, and will do just baout anything to take you money. I have read that Bally's is about the worst one of them all, even trying to strong arm some people to sign. Always read any contract and do not sign if there is ANYTHING you do not understand. Get every promise in writing, otherwise they are not accountable. In your case, I would recommend seeing a copy of the contract. They may have a clause for ending the contract if you move or have a medical reason. Other times, health clubs will just make you give them 30 or 60 days notice in writing. As a matter of fact, EVERY gym that I have researched makes you cancel the contract in writing, by certified mail. Depending on what the contract termination fee is, how close you are to your family doctor, and how good your health insurance is, it may be worth it to ask your doctor to write a note/letter to get her out of that contract.
