| I’ve had to sit down and be deposed quite a few times, and yes it can be a fishing trip but more often than not the plaintiff attorneys saw no merit ( or money) pursuing things further, and I recall having at least 3 tossed by the court for no merit…I ignored the half dozen or so handwritten ‘pauper’ lawsuits from prison inmates. All as a cop, and qualified immunity was never an issue. |

Got into a kinetic argument once and was prosecuted because the guy went to the DAs office after he got out of the hospital. Judge dismissed the case after questioning us and deciding the other guy instigated it. Another time a grand jury dismissed a case for me shooting someone. Prosecutor tried to make it sound like he was a 25 yo child. lol |

| Lol, he'll no , I asked for a lawyer during my first interview, so I never did more than show up arraignment/bond hearing, plead innocent, ask for court appointed lawyer, and then again for preliminary hearing(whatever the fuck meant) , and a couple more continuance before they finally dropped the whole sham of a mockery of justice that was jacomo circa 1993. |
| I've been in court plenty of times, usually as an investigator. After I retired, an ex-con sued me, civilly, along with two others. Similar names, same area of employment, no dates, times or details. I rather enjoyed being my own Perry Mason as I represented myself. I was very well prepared, so it wasn't quite as risky as it could have been. I won and gained some indirect benefits as well. |

The decision had been made well before we set foot in the courtroom, because that's the way Colorado rolls. On my way out, the prosecutor stopped me and asked if I'd ever studied law. When I said no, he said, "you should." |

Lots of traffic and small claims cases as both Plaintiff and rarely Defendant (not at the same time), but not for many years. People used to be able to get a fair and complete trial. Now, Small Claims courts for the last couple decades are largely "we ain't got time for your shit". Last 2 were 10-15 years ago and both landlord-tenant. Both cases (different courts), I was Plaintiff and judge never even let me present a case - asked me a bunch of questions before I could even present anything, then "GTFO and we'll send you our decision. Next!". Same with a couple other non-landlord-tenant SC cases about 20 years ago. It didn't used to be like that. I was Plaintiff in a SC case in 90s where judge actually gave a shit enough to reconvene court at my property to see for himself what I was suing about (shit roof job). You sure as hell don't see anything like that any more. Judge even complimented me on how well I presented my case. |

Never as the defendant. I’ve been on the other side of the courtroom half a dozen times, and I’ve never lost a case. I’m headed to arbitration in October over a $600,000 project that went to shit. The engineer’s design is at the center of the dispute, and right now I’m only a witness. I suppose some blame could come our way, anything can happen, but we’ve been told no claim is being pursued against us. |

Yep. As a first responder (volunteer firefighter) at a kidnapping/arson scene. Testified at his trial two years later. The perp tried to argue that the fuel and propane tanks adjacent the burning house were not a threat to the first responders or the neighborhood. As the acting fire chief, the prosecution tapped me to testify to the danger that burning fuel and rapidly venting propane posed to everyone. The guy got 25 years. |

Yes, for my friend's DUI. Cops lied...got caught lying...continued to lie. The jury was laughing out loud at them at one point. The prosecutor called me a liar on the stand and I stood up and yelled at her. Judge told her to STFU. Friend was found not guilty. It was a 3 day trial. |

I was deposed as an employee/witness of a defendant. Civil case - environmental issue. I kicked the plaintiff's attorneys collective asses. I owned those mfers. ![]() ETA: I've been deposed several times related to my professional work. When I get deposed, I'm the smartest guy in the room in my field. Lawyers don't stand a snowball's chance in hell. True story. |

Once. I was called as a witness for the defendant. I was the third shift supervisor and one of our employees was sued by her ex for driving through his property at night, blowing her horn, and tearing up his yard. The woman in question called me and copies of our time records to attempt to show that she hadn't punched out at lunch time (3:00 am) and therefore couldn't have done what he claimed. Lunch was 20 minutes. His place was five minutes from our plant. When I testified that no one checked if our employees left the building at lunch and had no way of verifying that they had punched out to leave the premises, his lawyer thanked me and dismissed me. Her lawyer was not happy. I don't know how it turned out but I have no question in my mind that she did what he claimed as she was a grade A bitch. (She also went on to accuse both me and another supervisor of fathering her kid. Joke was on her... I'd had a vasectomy years before and was sterile. The other guy? Not so much. |

I was contacted at work by a lawyer representing my employer regarding a case of harassment and discrimination. I was a supervisor of an employee who was a call-in problem, and after so many of them, I sat him down and counseled him regarding them. He got upset, verbally told me that he was quitting in two weeks and then called in sick the next day (thanks for proving my point). He later sued my employer, me, and my supervisor for harassment and discrimination because we were singling him out due to him being transexual. When the lawyer asked me if I knew this guy was trans, I was flabbergasted because there was absolutely nothing about him that indicated he used to be a woman except for his height. My supervisor and I were removed from the lawsuit. ETA: If that guy used to be a woman, he was one ugly bitch! |

Kind of. It was a sworn deposition in an insurance arbitration proceeding. It was eventually decided the other party was at fault. It was a very large claim. There was a fire at a nearly completed historic restoration/renovation project. I was the superintendent for the GC. |
| I worked corrections for 33 years. I was sued by inmates several times. I had to be deposed in every one of them but most got dismissed as frivolous before getting to the "court" stage. The ones that didn't I had to testify as a defendant. I won every time, even when the inmates had managed to find some shitbird lawyer to represent them. The ones that represented themselves were REALLY easy to beat...lol. The one that pissed me off didn't name me but did name several of my co-workers. They had done NO wrong. The inmate was lying 100%. I know, I was there during the supposed incident. The state decided to give him a few thousand dollars rather than fight it which made my people look guilty even though they were 100% innocent. Not cool. |

I have been questioned by lawyers in accident investigations. Most of the time the driver lied and they ended before court. A favorite . Whiskerz gave me a truck with a brake fluid leak and it resulted in me crashing. To which I replied. The truck has air brakes. There is no fluid. The lawyer ended it right there. |

I took a job as an accountant at a company in San Diego, turns out it was a sleazy company with a sleazy owner basically robbing people. Twice the company got sued in Los Angeles and the owner would make me represent with no lawyer. I would show up and offer no defense and was happy to see the people get a judgement in their favor. I quit that job when I had gone in on a Saturday to do something and he shows up and starts yelling at me because he couldn't find something. I applied for unemployment and even tho I quit I got it because he yelled at the lady on the phone when she called. That owner also made me do all the firing because he was a coward. I also had to bail his ass out of jail one time so everyone would get paid. Btw, that Los Angeles court house building you see in TV shows looks like a nice place. In reality it is surrounded by scum and villainy. A horrible place. |

Some free advice for those being deposed. Do not speculate. Attorneys will attempt to get you to speculate. Tell them, nicely, to fuq right off. Tell the truth as you remember it. Do not go beyond this. See above. Lawyers are assho. They will try to intimidate you, fluster you. They all think they're badasses. It's their job. Don't fall for it. You know what you know, and you don't know what you don't know. If you are being deposed about a former employer, who is now a defendant, the former employer might want you to accept their atty. as your atty. The employer's atty. is NOT your atty. or your friend. Rule: If you aren't paying the atty. he is NOT your atty.! I was told this by an atty. who worked for me in a professional capacity. "Lou, if you aren't writing a check, he's not your atty." If you are a witness and not a defendant, unless you are somehow culpable, you may not need your own atty. present. Let your common sense be your guide. If you think you need an atty., get one. I have been deposed several times. The cases never went to trial. If they had, I would have definitely been a trial witness. In at least a couple of those cases, my deposition probably caused the case to be dropped, or settled for a much smaller amount. I never got a thank you. When you get deposed, unless you are a professional witness, you will be the lowest paid person in the room. Even the stenographer and videographer will make more $ than you. IIRC I got $35/day for transport, which didn't even cover my costs. Remember this. They are trying to screw with the poorest paid person in the room. Don't let them. ETA: After the depo, you will get a written transcript of the depo. You have an opportunity to correct any errors. Use it! I have found many errors in transcripts. It is the OFFICIAL record that will be used in a trial. If you don't correct the errors you might end up getting screwed. |
