Dunno about Cali, but we have Castle Doctrine here, so maybe a trip to the station, but I wouldn't expect spending the night or more in jail.

In California, if you shoot someone who breaks into your house, there is a legal presumption that your actions were reasonable.
Being drunk really has nothing to do with it. |

We have castle law here in TN as well. No mention of drinking in the law. Someone breaks in my house when I'm home they are gonna get shot dead. Then again I don't get drunk so.....
