I work EMS for a small rural organization, and many times as full time employees we find ourselves working over 60 hours in a week due to lack of man power. The organizations policy is that we recieve standard pay for the first 40 hours we work, from 40-60 we recieve time-and-a-half, and anything over 60 hours gets rolled over into a comp time fund that we can use if we want or need to take a day off. Working 12 hour shift, I have often found myself doing 72 hours in a week, and have a nice amount of hours stocked up.
I am not interested in taking off of work, but I want my money! Is it legal for the administration to do this. The place is not exactly run by the sharpest knives in the drawer. Is it legal for them to keep the pay from us like that? I am in a financial bind right now and could really use all of that money I have stored up. It would make sense to me that I am entitled to that money when I choose. And I have a feeling that if I were to politely ask for it in one check that I would be told that that is not the way they do things there. Can some one help me out and tell me what I should do? Should I go in and demand that I be given my pay? In my opinion it is mine and I should be able to retrieve it at any time of my wishing. It would be alot better if I could explain to her why it is illegal (if it is) for her to withhold funds from me. |

You need to research your state DOL regs here in NC only GOV. employers and a very few private employers can do the comp. thing. |
