I might have already asked this question, but never got an answer. Here goes.
When a private indavidual sells their Class II weapon, they have to pay a $200 transfer tax to do the the transfer to the buyer? Does the buyer also have to pay a $200 transfer tax? |

Does the buyer also have to pay a $200 transfer tax? not necessarily. It depends how you have your deal set up. You can tell whoever wants to buy the gun that they have to pay the transfer and if you are selling the gun to an individual in your own state there is only one transfer not 2. If you are selling it to an individual out of state there will be 2 transfers. One 200 tax from you to his out of state dealer and once that clears another 200 tax from the buyers dealer to him. Again it all depends on how you set up your deal. Some sellers make the buyers responsible for any and all transfers. Some will split it with them if there are going to be 2 of them due to an out of state transfer. ATF could care less who pays the 200 tax as long as they get it for the transfer. It depends on what you choose you want to ask for in your deal. Your call.... your sale.... your deal. But again, if you are selling to someone in your state no dealer required and only one 200 tax transfer. Out of state..... 2 of them required and his dealer is needed as well. Rob |
