So I had a really strange one today and I'm not sure what to do next. A few days ago I had a lady come knocking on my door to ask if it would be OK to have a gun shipped to me that she was buying on Grabagun. Apparently she lives just around the corner and didn't realize I am an FFL because my main work is antique auto restoration/repair. She seemed nice enough, although a little trailer park-ish but hey, who am I to judge? At any rate, today UPS delivers an ATI AR15 with no buyer information in the box whatsoever, just a packing slip showing the serial number and saying that it was disposed to my FFL. Since the only other things I had inbound were shotguns, I figured out that it was her rifle, so I sent her a text saying that it had arrived. About 10 minutes later she shows up with what I assumed was her son (whom I later learned was 19 years old). I handed her the 4473 and had her fill it out, then I checked her answers and plugged everything into the computer. It seemed to be hung up on "Researching" but since my internet service sucks at the shop, I didn't really think much of it. She finally got tired of waiting, so they decided to run to the grocery store and swing back by on their way home. After probably 30 minutes the status changed to "New" and when I clicked the button, it put up a window asking me to input her address (never seen that). As soon as I put in her address, it immediately came back Denied. So now I'm not really sure where to go from here. They ended up telling me that the son actually bought the rifle as a birthday gift for her, so I'm not really sure what to believe at this point, but I wasn't sure what legal options she has short of me returning it to the wholesaler they bought it from. I'm not looking for any kind of work-arounds and I'm damn sure not going to break the law for her, but I don't want the hassle of having to return it or deal with the morons at UPS. What says the hive? Are there any other legal means of getting this plastic POS off of my books short of returning it to the Grabagun seller? Thanks in advance for the guidance. |

Step 1 - file all your denied 4473's separately because the IOI will want to see it during an audit. Step 2 - do not dispose of the gun to anyone in that household because the IOI will compare the name and address on the 4473 denial to where the firearm eventually went. Step 3 - before accepting transfers you should have created a policy for denials. This is ours: If the FBI NICS denies the transfer, the buyer has several choices: - We will hold the firearm while the buyer appeals the denial. If the buyer files the appeal within 30 days of the denial, no storage fees will accrue as we will not penalize buyers for the government's delays. If the buyer does not file the appeal within 30 days we will charge a storage fee of $10 (ten dollars) per week to store the firearm. Once the storage fees have exceeded 50% of the firearm's value we will sell the firearm, deduct our storage fees, and return the remainder to the buyer. - Arrange with the seller for the return of the firearm and pay us for return shipping. - Consign the firearm with us. |

After this lady left, I Googled her name and found an arrest record for assault from 15 years ago, so I'm pretty sure this one is a legit denial. She strikes me as the type who was probably a little rambunctious in her younger days and probably ran with a rough crowd. But like I said before, who am I to judge. I know I did plenty dumb stuff in my youth that could easily have caused me problems later in life, I just got lucky and never got caught!

I've had two denials and within 24 hours I've was contacted by my local PD asking for a copy of the 4473 so they can go after them. |

I did get super lucky in the fact that one of my buddies was in the shop a couple days later and when I mentioned the situation, he asked to see the rifle and then asked how much she wanted for it. I hadn't been able to get a price out of her, so we looked it up on Gunbroker and figured out that she'd probably paid $369 plus $25 for shipping. He offered her $350 and she took it, so I was able to get that one off my books quickly and legally. |
