So, as many of us, I'm thinking through building an SBR.
A few questions: 1. Was thinking of going the Corporate route - What are the advantage/disadvantages between the Trust and Corporate registration? 2. If I already had a few AR's in the safe, what, if any, issues are there with having a spare SBR upper in the safe? Say I wanted an 11.5" and then bought a 7" for the same registered lower? Is this intent because I have other lowers available? |

I'm in the middle of my first SBR as well. I really can't give good information on the 2nd question, but I did go the trust route. I did it because I can completely avoid having to get a CLEO signature or fingerprint cards and once the trust is set up, I can simply fill out the form, insert copy of trust, nd send it away. Another good thing is that if I die, then my wife gets the property (right now, 1 SBR, but will grow...). If my wife dies, then my dad gets it. It provides another legal barrier to your property being distributed as the state sees fit.

You can have as many different SBR uppers to go to your 1 lower as you want.
Having another lower which is not registered but has a legal configuration at 16" or longer is GTG. I have one for my 6.5 Grendel upper. I could theoretically sell it and run my Grendel upper on my SBR'd lower, but I already had it and the ATF doesn't care. I have a legal configuration for all my short uppers––-they all attach to one lower. And it has a tax stamp attached to it. As far as doing a trust––-it takes less time to setup one than a corporation and such and if the corp ever closes then you might be in hot water. I just went with a RLT for mine. |
| The uppers/lowers combinations seems to always result in several answers. Currently, I have two built lowers and three 16"+ uppers. I have one unbuilt lower on a Form 1 and am in the process of building a 9MM SBR. I have one additional unbuilt lower. Thus I can put together three 16"+ rifles and one SBR with nothing left over. If I obtained another SBR upper, I would still be legal since I can put together legal configurations of 16"+ uppers and can only have one SBR at a time using the one lower. The additional SBR upper would be in the safe. Is this correct? |

Yeah, just wanted to make sure I didn't get into a situation where I could have two complete 16" carbines and a complete SBR in the same safe with a second SBR upper. Didn't want to get into an issue where I could be accused of placing the second SBR upper on a non-registered lower. The LLC is mine, so if it goes away, I'll have a lot more to worry about than a rouge SBR... |

Having the second SBR Upper in the safe wouldn't make any difference, it's still there. Having an extra "un-built" lower along with a spare 16"+ upper and a extra SBR upper could still be a problem since you could easily pin either spare upper on the unregistered lower. I would build the 3rd 16"+ upper on the spare lower to remove the "intent" possibility. |
