CHARLESTON, W.Va. — A New Year’s Day milestone arrives Thursday as West Virginia officially eliminate state income tax on Social Security benefits for all remaining residents.

Beginning Jan. 1, the state will implement a 100% tax deduction on Social Security benefits regardless of income level.

The move completes a three-year phaseout intended to provide tax relief to higher-earning seniors who were previously ineligible for the full exemption.

The final stage of the rollout benefits single filers earning more than $50,000 and married couples filing jointly earning more than $100,000.

Those taxpayers saw their deduction rise from 35% in 2024 to 65% in 2025 and will now be able to deduct the full amount of their benefits from their West Virginia adjusted gross income.

“For taxable years beginning on or after Jan. 1, 2026, 100% of the Social Security benefits … included in federal adjusted gross income for the taxable year shall be allowed as a decreasing modification,” the legislation states.

The change applies to all benefits received under Title 42 of the U.S. Code, including Old Age, Survivors, and Disability Insurance benefits and Supplemental Security Income for the aged, blind and disabled.

Lower-income West Virginians have already been eligible for a 100% deduction under rules established for taxable years beginning on or after Jan. 1, 2022.

The full elimination of the Social Security tax also affects other senior tax provisions. Under state law, West Virginians 65 and older, or those certified as permanently and totally disabled, may generally claim an $8,000 deduction from gross income.

However, the code specifies that if a resident’s total modifications from other sources — such as Social Security, military retirement or public employee pensions — exceed $8,000, the additional deduction cannot be claimed. For many seniors, the full Social Security exemption beginning Thursday will exceed that threshold, effectively simplifying their tax filings.

The Jan. 1 effective date also places Social Security benefits alongside several other types of retirement income already exempt from the state personal income tax. Those include full deductions for military retirement pay for the armed forces, reserves and National Guard; retirement income from the Army, Navy, Marine Corps, Air Force, Coast Guard, Public Health Service and National Oceanic and Atmospheric Administration; and benefits from West Virginia police and firemen’s retirement systems and the West Virginia State Police death, disability and retirement fund.

State officials have said the 2024 legislation was intended to simplify the tax code, remove obsolete language and make West Virginia more competitive for retirees.

A fiscal note prepared by Deputy Revenue Secretary Mark Muchow estimates the exemption will reduce General Revenue Fund collections by $37.7 million in fiscal year 2026, with losses expected to grow in later years.
