I just had an out of state vendor say the stay (issued the other day) put the standard cap mag bans back in effect. I have not seen this anywhere else and LGS were selling ARs and mags this weekend. Are they mis-interpreting things? |

I’ve been wondering the same. Is the “stay” for the injunction to stay in place? Or is the “stay” for the injunction to be “paused” since it was enjoined with the other cases?? And the other cases combined??? IANAL - so it’s clown world, who the hell Knows. The injunction states that a FFL/vendor can choose not to stock AW and/or magazines and it is their choice and do not require to do anything they do not want to do. So this person/vendor is simply exercising the part of the injunction to say that they do not want to sell or transfer what falls under the AW or magazine ban. But yes, I did go to the range I usually go to and yes, I see magazines for sale still. So I do not think the "stay" has any sort of negative effect. Yes, it should be safe so long as you bought them during the injunction. As far as I understand the "stay" order, at least from what I understand here and maybe someone can correct me is that it is a way to where they can't rule on each thing individually so that one court says one thing and another says another. It's basically saying that all the cases have to pause until the SCOTUS ruling comes back. The injunction itself is still in effect and while it is, you can purchase the magazines if the FFL decides so. I think the only cloudy thing here is that Jay Jones clown says it is a victory for him, whatever the heck that means. From what I can tell, Jay Jones is betting on getting the cases rolled up into one case then present it to a blue friendly judge who will rule in his favor. That would be the only potentially bad thing about this "stay" order. |

I’ve read a lot of differing opinions about this, along with comparisons to California’s Freedom Week, and I’m not sure. As I understand it, the ban is still in effect, but the injunction just prohibits law enforcement from enforcing it. If a court eventually rules in favor of the state that the ban is constitutional (unlikely, in my opinion), the injunction will be lifted, and the law will have been in force in July 1. That means that law enforcement would no longer be prohibited from enforcing it. They could theoretically prosecute people for buying prohibited items after July 1. Whether or not that’s likely is a whole discussion by itself. My understanding from reading about California is that the judge out there continued the injunction pending resolution of that case, to protect people who bought magazines during that week. Last I checked, that case is still winding its way up to SCOTUS after all these years so hasn’t been resolved it. That seems to indicate that a judge here in VA would need to make a similar ruling to keep the injunction in place for the time period that it was in effect, if the law inevitably stands. That process is not automatic, from what I can see. Originally Posted By Spade: I was at Academy Sports a couple weeks ago and they were selling regular sized mags. I would say most of it is hypothetical and just designed to scare you. A common “scare tactic” California uses is saying they’re arresting people who go cross state lines to buy magazines at gun shows having a strange story with many holes in it about someone who was recently arrested with illegal magazines he got from a gun show across state lines. My guess is that they’re just trying to scare citizens with “we’re watching you!!!” Big brother tactic. Keep in mind this is only if the scotus decision rules against gun owners by saying states can limit aesthetics configuration of a firearm. If we get a favorable ruling there’s a good chance they’ll just re-introduce the bill but it is a magazine ban. It will probably be very restrictive where grandfathering won’t be permitting because the scotus ruling won’t include magazines. |

Be a hard-ass. Every day should be like his first day in prison, and he's all alone in the yard without a shiv.

I would say regardless of the outcome of the scouts case and regardless of the outcome of the Virginia sc case, they’re probably going to do this. But I agree they’re not going after anyone post injunction as in going to stores and figuring out who bought what and going after them. But they are most definitely coming after us by passing a magazine ban. |

They didn't have a lot but I definitely noted some 20 round .308 AR mags. |
