If there's a few seconds between the video stopping and the first shot being fired, it's going to leave questions. |

Just reinforces my belief that you never get out of the car when someone is acting stupid.

With the limited facts of the case presented here, it looks like the lady should be in the clear. The guy is a large adult, apparently able-bodied male. He easily has the physical means to cause death or great bodily harm. Factor in his likely significant advantage in size and strength, and the disparity of force clearly favors the male attacker here. He closes the distance to the female and appears to make some sort of physical contact, which means he absolutely has the opportunity to bring his physical means to bear. He approaches aggressively, with no indications that he is approaching for any legitimate reason, and (presumably, from the video) actually makes aggressive physical contact with the female. This, IMHO, can be reasonably perceived as manifesting intent to cause death or serious bodily injury, which satisfies the requirements for jeopardy. Means-Opportunity-Jeopardy -- this makes this man an imminent threat of death or serious bodily injury. Under Tennessee's SYG law, the lady has no legal duty to retreat before using force (although IMO she should have). She gave good verbal warnings, and defended herself against the imminent threat. Good shoot. (Again, based on what we see here). |

Ol' Rev out "talking religion' at a bar? I doubt it, but good cover story for the beloved pastor. Seems like he physically engaged her which made her drop her phone in favor of something more defensive. Not that it ever would be, but if my wife were approached by that man after having a previous physical encounter, I'd hope she shoots him too. I don't see her getting convicted, unless she gets a horrible PD, or the fix is already in. |
