"Flying through" - at the Interstate speed limit next week. Reading the FAQ above looks like I can OC w/o a license or keep the pistol concealed, unloaded, w/ the mag in my other pocket. Can't carry into any place that sells any alcohol, including WalMart. Anything changed in the last decade? Any restrictions on carrying a knife? 5.5" folder, Texas bar legal, I like to visit my Baptist friends w/o recognizing them. |

| I’m probably not the best person to answer this but, unless you have your concealed carry that is reciprocated in NM it might not be an option even with mag in another pocket. I know that you can’t carry open or concealed any place that has no guns sign posted. Governor passed some bill not allowing carry of any kind at parks or play grounds in Albuquerque metro. Only knife law I know of is no automatic knives you can own them but can’t carry them. Hopefully someone more wise on our laws comes along to help you out with better answers. Have a safe trip! |

New Mexico knife laws are pretty vague and mostly at the discretion of the arresting officer and prosecuting attorney. Most of the laws refer to "carrying of a Deadly Weapon" and not specific to what knives are considered a deadly weapon. Bowie knives, switch blades, and daggers are called out specifically and other than some case law the difference between a pocket knife and a deadly weapon is not defined. Your vehicle is generally seen as an extension of your home when it comes to possession of various weapon and concealing them in your vehicle outside of specific circumstances is allowed. One major caveat is that NM has many tribal jurisdictions that have some road travel exemptions but only while traveling those state/federal roads. Similarly for concealing an unloaded pistol, it is not clearly defined what constitutes "unloaded". So mag in a different pocket is a safer bet than in same location as firearm but if an officer wants to push the matter carrying both the firearm and the mag on your person at once may give them enough to at least charge you with unlicensed carry. You can generally carry an unloaded gun where you would be able to legally open carry. |

Thanks guys. Will do our best to fill up before we leave Constitutional Carry & not stop again til we reach Constitutional Carry. Was reading your posted laws @ the top of the page - has something changed on Open Carry & unloaded CC carry? |

Nothing law wise has changed since they added Licensed CC at state parks. That said, between tribal laws and the state laws not strictly defining certain aspects of both concealed carry of a firearm and carrying of a pocket knife it leaves a lot of discretion to the officer on-scene. Outside of the Albuquerque, Santa Fe, Las Cruces, and maybe Taos you likely won't have any issues in non-tribal areas. |
