FRTs in Florida? (Page 1 of 3)

I know Rick Scott gave us such a gracious parting gift of Statute 790.222 that makes "bump stocks" or other devices or accessories that "alter the rate of fire or mimic automatic fire" before pissing off to Senate. I also know that Supreme Court ruled that bump stocks/FRTs/etc are legal and DeSantis has called for repealing the "bump stock ban" in Florida, but has anything been done since? Is this on anyone's radar where it should be? I see that H6013 is in committee as of 2/12/25, but does anyone in-the-know have any insight as to the chances? |
| Given how much I've heard lately about our wonderful republican't legislature wanting to defy the governor on things and the great work they've done trying to oppose his immigration reform, I'm maybe less than hopeful that they'll recognize and fix their past mistake. I'm more hopeful that we'll eventually have a case go to the FL supreme court to get it struck down, because the only other way I see involves a significant overhaul of the FL GOP and the people they put up for office. |

You're not the board darling you think you are.

And more than a few of these manufactures won't reveal who might stock them in legal states. No PO boxes or in person pickups. I can kinda understand their point but I damn sure don't consider them as underground freedom fighters when they won't do something legal for fear of being drawn into some legal drama. |
If you think I am sexy now just wait until you find out I have full medical and dental.

It'd be nice if the AG could come out with guidance to the effect of "the assumed rate of fire of any semi-automatic firearm is its cyclic fire rate" coupled with "integral components essential to the function of a firearm such as bolt carrier groups, buffers, and action springs shall not be considered bump stocks" so we could basically render the whole stupid statute moot. Maybe give some guidance that "automatic weapon fire shall be construed as the maximum achieved rate of fire of a machine gun" so anything that doesn't out-run a minigun is good to go ![]() Failing that - the law specifically refers to "a conversion kit, a tool, an accessory, or a device used to alter the rate of fire of a firearm" so maybe guidance to clarify that a firearm originally equipped with a "bump stock" doesn't violate the statute? It's a shitty and limited avenue to claw back some of the freedom our legislature and Rick Scott gave up, but it's better than nothing. Plus at that point who's to say you didn't take a vacation to Georgia, buy an FRT in a private sale, and build out a stripped lower on it before you came back? Didn't alter the rate of the firearm unless they want to claim you altered it from 0 to "not 0" and kick the hornet's nest of unintentionally banning everyone from assembling their own lowers. Also, the statute says it's a violation of FL law to keep or offer them for sale. If RBT doesn't prohibit that, they're technically in violation of FL law. I imagine they aren't in a mood or position to pick yet another legal fight, but they'd probably be a great plaintiff to get the statute tossed if it went to court and the AG took the opportunity to not defend it from getting struck down... |

IDK, most of them are. Maybe not. I didn’t see the expected hit up for payment via Zelle or Amazon gift cards on the website. Is the real RareBreed based in Texas, now? Still, tread carefully. The Florida “bumpstock ban” is such a poorly written law, it means ANYTHING an overzealous cop or prosecutor on a mission wants it to mean. |

It's not written poorly, it's written with the intention to enable exactly what you described. This is malice, not ignorance. |

My initial research tells me it does not increase the rate of fire. Again, this law is all about subjective feelings. 790.222 Bump-fire stocks prohibited.—A person may not import into this state or transfer, distribute, sell, keep for sale, offer for sale, possess, or give to another person a bump-fire stock. A person who violates this section commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. As used in this section, the term “bump-fire stock” means a conversion kit, a tool, an accessory, or a device used to alter the rate of fire of a firearm to mimic automatic weapon fire or which is used to increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device. A trigger is not a stock but the law seems to imply otherwise. If I build a an AR from an 80% or even a virgin lower with an FRT from the start, then what is used as the basis to determine “increase the rate of fire to a faster rate than is possible for a person to fire such semiautomatic firearm unassisted by a kit, a tool, an accessory, or a device.” If I were on trial for violation of this law, WHOSE ability to fire the gun faster would be used as the litmus test? Could I bring in Jerry Miculek as a subject matter expert on my behalf? Does adding a Geisslie SSA-E trigger or any other boutique target or competition trigger violate this law? Is the measure of “faster rate” split time between shots or averaged rounds per minute? Whatever YOUR answer is, it is subjective and may or may not make you a Felon. Remember, Pam Bondi WROTE this law and Florida Republicans shoved it down your throats, confident that you will still vote for them. Let’s scrap this bad law and replace it with something like; “if use a gun in the commission of a violent crime, you go to prison for the next 30 years in addition to a conviction for the violent crime”. Make Florida Republican politicians worry about their next election campaign. |
